Indigo and ZZPS demands

Hi,
Quick background. The Driver parked the car in a full car park outside of an authorized bay. A ticket was issued. Previously, the driver has been issued two penalty notices for forgetting to pay for a ticket. after following the excellent advice on this site, both notices were quashed.
The problem this time is that after the latest notice the driver came back to the site and after rereading the newer threads, for some reason didn't think it was necessary to send to send an appeal after 26 days.
The Owner is now receiving demands for £170 from ZZPS and is not very happy with the Driver(!) as they are concerned that this will affect their credit rating/score. (The Owner never receievd any letters from ZZPS on the previous two tickets as they were quashed on appeal)
Is it the correct procedure to ignore the ZZPS letters, or has the Driver messed this up by not appealing the orignal penalty notice and should just pay the £170?
Many thanks

No-one pays Indigo. Not 70p, let alone silly extortionate money like £170!
If it's a railway car park read the thread about Indigo/railway car parks, that's linked in the NEWBIES thread Q&A section.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi,
It is a railway car park and I have successfully used the by-law defense twice previously. I fully understand the reasons why Indigo can't enforce these penalty notices, but in this case the Owner is now very nervous as they are the one receiving the demands.
My question is, should the Driver advise the Owner to just ignore the letters from ZZPS or should they engage with them(ZZPS) at all?0 -
Everyone should ignore letters from ZZPS or Zenith or any other debt collector.
There is comprehensive guidance on how to deal with debt collector's letters in post #4 of the NEWBIES FAQ sticky thread.0 -
The OWNER should not be afraid of their credit score being trashed , because its a myth
it can only happen if there is a court case against them , they lose in court, then they fail to pay what the judge says within one month
only then is their credit score trashed by the CCJ
so if the apocalypse happens , and they lose, they should pay it off , IN FULL, within one month , in order to preserve their credit rating
in short, they should actually find out the facts before worrying about a non-event that clearly has not happened yet
this person needs to come back if they receive an LBC or an actual court claim (an MCOL) within 6 years
in theory, the TOC (not INDIGO) could take them to MAGISTRATES COURT within 6 months due to bylaws applying, so string it out past the 6 months deadline, its all hot air after that0 -
Right, reread NEWBIES and re-educated myself. Thanks again for everyone's help and apologies for for not reading the NEWBIES tread closely enough, and wasting your precious time. The drivers and owners mind will now put completely at rest again.
You all do a magnificent job here! Thanks again.0 -
Read here about CCJs and credit rating.they are concerned that this will affect their credit rating/score.

And stop the owner worrying! Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Ask the driver to read this and complain to their MP.
This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.
Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct
Hospital car parks and residential complex tickets have been especially mentioned.
The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the House of Commons recently

and complain in the most robust terms to your MP. With a fair wind they will be out of business by Christmas. You never know how far you can go until you go too far.0 -

Even if taken to court and found guilty it's a byelaws offence and would have no impact on a credit score. There would be no ccj either as it's an actual fine.
Not that any of that would happen of course.
This is why we recommend engaging with Indigo. Mostly because people get twitchy doing nothing. People seem to need to do something. If it would make him feel better he can write to indigo saying he wasn't driving does he or the driver have to pay?
You can string out at least 3 months before naming you as the driver. You can then appeal. By the time you are told it's too late it really will be.0
