Hi,

I need help please.
I have tried reading through the forums but I'm just getting more and more confused.

I received a letter from Parking Eye at the end of last year - I took advice from friends and family to just ignore it. I was at the cinema and the rules of the car park had changed recently.
I have recently got a letter from the County Court Business Centre and Parking Eye saying a CCJ will be going on my record unless I pay £200.

1. I cannot afford to pay £200 and don't think I should have to for legitimately going to the cinema with a friend.
2. My existing mental health issues are being adversely affected by this to the point where I'm losing the will.

I need help on what to do here - I'm struggling to deal with this mentally.
How are there people in this world who can do this to people going to the cinema with friends.
Clearly, if I had seen any signs I would have entered my reg number into a machine to prevent this but saw no signs.

I'm not sure how much longer I can deal with this and the threats.

Any help would be great please.

    Wow that was daft. PE sue the pants off people. Easy to appeal and win, with our help at the time!

    Is it a claim form? If so, acknowledge it online, then defend, just as the NEWBIES FAQS THREAD (the one in capitals, 2 clicks back, where you hit ''new thread'') explains.

    Hopefully not a Judgment in Default letter if you went and ignored a claim form?

    So, which is it and tell us when you've done the AOS and read the NEWBIES thread, first please.

  • It is a "Judgement for Claimant (in default)".
    I don't know what any of this means.
    I've tried reading the newbies thread but it's quite honestly like reading a foreign language - not sure if I'm looking at the wrong thing or if I'm just incredibly dumb.
    What do I need to do?

    What is the date of the judgement

    Depending on how old it is will mean you have different options

    Maybe you can get someone to assist you.

    Concentrate on #2 of the FAQ which does cover default ccj.

    (Now you have a default ccj against you then it's already registered against you. Depending on the answer to the date question you may have an opportunity to get this set aside - though unlikely if you simply ignored all Court correspondence till now)

    The only date I can see on there is 5/7/18.
    I have since received another letter from Parking Eye Legal Department saying I have 1 month on the date of the judgement was granted not the date of the letter but there's no actual date on there.

    In my opinion, given your circumstance, and the fact that you are in this position because of disasterous advice from family and friends, you would be well advised to settle, try an offer of £5.00 a week.
    You never know how far you can go until you go too far.

    You lost - you actually ignored a court claim form, that arrived from the court a month before.

    OMG.

    Now you will have to pay it, quickly, to avoid a CCJ.

    And this could have been cancelled with one appeal or complaint to the retailer, at the time. Blame your friends/family, the idiot who told you to ignore it instead of Googling and finding us in time.

    If the date of judgement is 5/7 then you can stop this ccj remaining on the register and your credit records if you pay it off in full within a month from that date (you do now already have a CCJ on the records)

    Otherwise your choices are:

    Ignore it and hope they don't take enforcement action against you (, bailiffs/attachment of earnings etc)

    Offer them a payment plan

    Both of these will mean that the ccj remains on your record for the 6 years

    As others have said, those who wrongly advised you are responsible and should now pay it for you!

    Friends and Family REALLY need to be told about Parking Eye vs Beavis, whcih was decided by the Supreme Court 3 years ago. Parking Eye WON.

    Now it isnt all doom and gloom but as a result we deal with a lot of claims

    AS you have lost, because you ignored a claim form, you must either immedaitely pay up OR if your credit history isnt of concern to you, and you can evidence lack of funds, then offer them a reasonable payment plan. £5 per week may be enough if you are on low enough income.
