Hr threatening me

So I quit working for a now ex best friend as her partner the boss at the practice bullied me..long story anyways..ive asked for my wages according to the contract I had and now im being told i was issued a new contract and they have proof that they did and if matters are taken further ie if im thinking tribunal then they will show as and wen required they will show the proof???? Also to my best friend I asked the question if I could be paid cash in hand then i could show it with my home business, they refused which was fine...hr are threatening me with " the accountant told them that I had approached them to pay me cash in hand to get more tax credits"..i never spoke to him i only spoke to my so called friend...now the lawyer hr guy says he needs to look at the cobsequences of this as he is under oath...can someone please put me at ease as im sure its not illegal to ask for cash in hand as long as both sides pay the correct taxes???

Cash in hand, implies that you want paying without paying tax/NI etc
Being paid in cash, with a wage slip and appropriate tax/NI deductions is entirely different and perfectly ok.0 -
If the income is from employment, the employer must operate PAYE. Yes it can be paid in cash but it must have the appropriate tax and ni paid and payslip provided. They face penalties if they don't operate PAYE correctly so your request is unreasonable and unnecessary.
Declaring it on your own tax return wouldn't ensure the correct NI is paid.
Cash in hand is generally the term used when avoiding deducting the correct tax/ni. Any sensible employer would say no.0 -
We obviously can't know exactly what was said but if the 'lawyer hr guy' has raised concerns the situation needs to be fully investigated. It could be something as simple as different interpretation of terminology e.g. requesting 'cash in hand' when all that was being requested was 'payment in cash'. The former, as others have said, is often interpreted as meaning no tax or NI would be paid on the money.

She can't just choose to call it self employed income though. How could the employer guarantee the tax would be correctly paid? And it still impacts on the employer as the correct NI wouldn't be paid.0 -
Cash in hand was never paid therefore no laws were broken. What the OP asked for and why they asked for it is absolutely irrelevant. No tribunal is interested in a crime that didn't happen neither is HMRC.
The OP's problem appears to be their final pay has not been received.
OP, did you work your notice period? Do you have a signed copy of your contract?
