In October last year, I purchased a new Huawei phone from a company on Ebay.
In January this year it went wrong, would not stay on mobile data, was switching continually.
I tried everything to fix it, to no avail.
I sent the seller many messages and finally received and answer, was told to contact Huawei, which I did,
When I gave them the IMEI number, they told me the phone was made specifically for the Singapore market, should never have been sold in the UK, and they would not honour the guarantee.
I then contacted the seller, many times, they finally gave me an address to return the phone to, which I did, using Royal Mail, recorded and signed for.
They are not answering my messages, so I am now £400 down and have no phone.
Ebay and Paypal are not interested!!.
ANY IDEAS??

    As you returned the goods you have an address for the company. Send a Letter Before Action demanding a refund. If they fail to respond take them to the small claims court.

    Send any correspondence by first class post. Use a post office and get a free certificate of posting. Do not use signed for mail.

    As I posted there "I would not be sending this back anywhere as I can't see a way for you to ensure you will get anything back at all". Unfortunately it seems I was right, seller knew there was nothing that could be done to force him to refund , your only recourse now is to see if it's at all possible to sue an overseas seller in their own country, I suspect this is going to be unrealistic.

    Do get the threads merged though meanwhile in case others have any suggestions.

    Op never mentioned it was an overseas seller in the original post here. Just shows how having two threads running leads to poor information.

    All you can do is send a LBA but I'll be surprised if you see your £400 or the phone again. This is the risk of buying from overseas to save a few quid.

    If you paid by Paypal, did you use CreditCard as method of payment or debit card or paypal balance?

    Wondering if you have a chance of claiming a chargeback from your bank/cc?

    I know people will probably say you can't, but you have nothing else to lose.

    if paid by creditcard/debit card, ring them and ask for chargeback and explain you bought something faulty, seller told you to return to an address and get refund. You sent back with recorded delivery and here is the proof it was delivered back. But seller is not refuding you nor they are returning your calls. They will/should log a chargeback with paypal and paypal will then chase the seller and ...

    A LBA needs to be sent to the business address, as per the original thread there is no business address displayed, the phone has been sent back to an address that seller (or someone responding to their emails) gave by email and as seller is registered in Singapore may or may not be connected to seller at all.


    Do look at the original thread, OP has basically sent the phone to a random address, if that address is not the companies legal address then an LBA won't help at all as any court action would need to be addressed to the correct person or company to even have a chance of success and the company appears to be registered in Singapore.

    Looks like they took a holiday, they currently have 228 items listed and 11 sold between April- July. I suspect they are struggling to sell any Singapore market phones within the UK, I'm not sure many would risk a purchase like that from such a low feedback seller.
