Just to add that the upshot of this may be that they stop accepting cards rather than you being able to pay by card at no extra cost.
Taxis unfortunately don't have the option of adjusting their prices to work card fees into them.You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0 -

While your first point is a distinct possibility, it's clear that in the case the taxi has found a way in which a fee for card payment can be applied, so it should be possible to apply such a fee using the same method to all payment types if that's the road they want to go down. Whether their local authority licence would allow them to do so is another question.0 -

So their current card fee is invalid/illegal in two ways rather than just one. Which I guess is another route to complain by reporting them to the LA.0 -

Not exactly.
According to the council rules, they can't charge more for the fare itself but the council rules don't prohibit them from charging a surcharge for paying by card (which they can't do due to the payment surcharges regulations).
According to the payment surcharges regulations, they can't charge more for paying by card but the regulations don't prohibit traders from passing those costs on to customers, just it must be built into the base price (which they can't do because of the council rules).
