Judge agreed again that the signage was confusing due to the presence of the council sign too. Thanks for people on this forum for their help in other threads too! Another Gladstones loss!
That's excellent to hear maserati89! Did the new 'Parking (Code of Practice) Bill' help in your case, or did it precede that? https://www.gov.uk/government/news/drivers-to-receive-greater-protection-against-rogue-private-parking-operators0 -
Whilst The Parking (Code of Practice) Act 2019 is now law, the actual Code of Practice is yet to be published.
That press release, written in March this year, says:
Government Departments seem to be busy with other stuff. The new Code of Practice will be drafted later this year with industry stakeholders, and will provide the clarity of a single set of rules for private parking, with clearer processes of appeals.0 -
Hi psdie,
No unfortunately not, from what I've what that hasn't come into force yet. It was the council sign that won it for me, the judge agreed it was confusing to have both council signage and Links there.
I'd be weary about advising other people to fight these cases in the future, had it not been for the council signage I think I would have lost this case. The judge was not interested in any of my other points despite the fact Links signage is hidden behind bushes!0 -

Well done, yet another defeat for Gladstones and it's because they don't have a clue why they bring the claim ????
The judge only needs to select one thing to dismiss the case and that's what he did in your case. You had plenty of other points to zap this dodgy legal
It is wrong to say you would be wary in advising others about going to court, especially as judges are fully aware of the antics of the dodgy legals.
Every court experience is different but ..... you got Gladstones spanked yet again, and that's all that matters0 -
Well done - ANOTHER ONE BITES THE DUST!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
