Housing association tenancy agreement

Can anyone help??
I signed a tenancy agreement last Thursday for a gorgeous apartment it was exactly what we were looking for, on Friday night myself and a friend arrived to begin cleaning after being there for around an hour a gang of teenage lads arrived being very noisy and started smoking cannabis and doing the laughing gas balloons right outside my windows! They were all staring up at me whilst I was cleaning the windows and I also heard on numerous occasions “they won’t last long” . On leaving The apartment one of the lads went straight up to my friend and said I hope you know there’s plenty more of us. I have not moved in to the apartment and have put all delivery dates on hold for my furniture as I have since found out the previous tenant asked the gang to keep the noise down once and ended up getting stabbed in the hand and a couple of days later got beat up in the car park! I am absolutely terrified to move in there and would like to know if I could possibly end the tenancy! The tenancy is with a housing association please help

    If you have signed a social housing tenancy such as a probationary tenancy, fixed term tenancy or assured tenancy then yes you can usually terminate these with 4 weeks notice but this will be written into your agreement.

    As you only signed it a week ago you should be familiar with the content.

    Beware! If you terminate your tenancy you will make yourself intentionally homeless and the council will have no duty to house you.

    Did you ask about the area before you moved in?

    If you have rented a market rental property via a HA then you have not be able to terminate for 6 months. Again your tenancy will inform you.

    You would normally be given a copy of the tenancy agreement when you signed for the tenancy, and this should set out the procedure for ending the tenancy.

    You would normally be required to give a notice period when ending the tenancy, which can often be a minimum of 28 days. You will also be liable to cover the rent payments during the termination period.

    Here I had to give a months notice on my tenancy. Unfortunately in housing association areas teenagers can be more challenging. I found the best way to deal with them is to be reasonable, don't rant at them in other words. But let them know there are boundaries. A few years back I caught a group of them in my shed smoking cannabis. I simply said to them "hi, lads please can you come out of the shed", when they did said "thanks" and got no grief- they'll say hello. If they are on the path and I need to pass I just say excuse me as I would to anyone and they will move. They will be trying it on because you are new to the place, you'll probably find youngster think it's funny to ring your door bell and run away. Who told you the last tenant got stabbed?
    Paid off the last of my unsecured debts in 2016. Then saved up and bought a property. Current aim is to pay off my mortgage as early as possible. Currently over paying every month. Mortgage due to be paid off in 2036 hoping to get it paid off much earlier. Set up my own bespoke spreadsheet to manage my money.

    Speak to the HA. If this is an ongoing problem its very likely they will be aware of it. They may be able to offer an alternative and will explain how to end the tenancy.
    Also try contacting the police on 101 explaining the situation and asking if there is a history of problems locally.
  • Hi I'll start with sorry about spelling etc.I have been renting a 1 bed flat from housing association for 2 years and I'm on an assured tenancy but the housing I am with have helped me get a 2 bed house that I can have and it's a management swap but will i be put on a starter tenancy again.

    No. You cannot swap on a starter tenancy and so you cannot receive one.

    You can receive a fixed term though. To avoid this you should be checking the tenancy type of those you discuss swapping with.

    However before you do a swap its best to understand it so I would recommend a chst with the mutual exchange officer atbyour Association and read the policy.

    I second this, don't show them you are afraid, as above be civil and don't tell them off. I know it's hard but they'll come round if you stick to your guns but be pleasant. My mum always gave me good advice, anywhere you think of moving go and have a look at different times of day, see who is around. I would still say move when you are able but I am not sure when that is, sorry
