Company won't change TAX code dispite HMRC emailing them twice.

    I am not sure what you mean about the last post not working. I have been working in tax in the UK for quite a long time now, have applied the approach I stated in my last post, and never had an issue with HMRC, clients, or employees from working in the manner I explained. At the end of the day, it is not optional whether an employer uses the latest code received.

    What I have seen is employers/advisors taking a view on new PAYE codes issued to them and continuing with the more favourable old code, and then being hit with Reg 80 determinations for the shortfall in PAYE and being unable to recover it from the employee. I do not think that the accuracy of the code is relevant to Reg 80.

    Personally I have been dealing with HMRC and its predecessors since 1991. The UK tax service has never been worse in that timespan than it is now. PAYE codes still have numerous errors in them, it is still an issue which puzzles clients until I explain the existence of the HMRC Numpty Department to them when the daft codes all make sense.

    Is the clue here that maybe Samantha has two jobs, the "first" using up all her tax free pay therefore the second (shop) employer cannot apply any free pay? apologies if I haven't expressed this accurately, Im no expert!

    Could well have something to do with it.
    If the OP is still checking this thread can you give some more details.
    If you have two employments what are the following from your last payment in each employment....

    Taxable gross,tax paid,tax code/basis,taxable pay to date and tax paid to date.
