Brought a flat on the assumption it has a parking space when it doesn't!

Could you ask a couple of the neighbours about this? That being - say to them that the parking spaces seem to have been re-numbered and ask whether anything has happened to their space in the process (general implication of "Oh workmen...they do manage to muck things up sometimes - so I'm trying to find out exactly what they've done here to work out where my space No. 22 now is".
Best of all would be if you can find out who is allocated the adjacent parking spaces, ie no 21 and no 23 and see whether their parking spaces are still the same and work out from that where yours "should" be iyswim.0 -
The numbers on our car park don't run sequentially. I am number 22 and next to number 26. When I moved here someone was in my parking space (the numbers, not very usefully, are on the floor). Thanks to a helpful neighbour I found the culprit. It was my next door neighbour who had been used to my house being empty and used the space for his second car.
I second asking your neighbours. It would likely be quicker than trying to get hold of the freeholder.0 -

This. Go back to the management company quoting the lease.0 -
How old is the building? I am wondering if this space has fallen victim (not necessarily recently) to cars getting bigger and one space not being used for a long period of time. But a banker, engaged at enormous expense,Had the whole of their cash in his care.

To me it also seems strange that the previous owner even though it was rented for 5 years, seemed to have no knowledge of this and also had a working fob and the alarm code!
It seems clear that there should be a designated parking space for your flat.
Did the previous owner never use his space?
Have you checked the plan for the space that should be yours?
What is the number now shown on this space after the repainting?
Contact the managing agent with your evidence and ask for an explanation.0 -
Had you asked the solicitor about parking?ChloeLangford wrote: »Hi, davidmcn,
At no point did me or the solicitor discussed parking. .
If not, how would he know you were expecting parkig?
When you checked the lease before buying, what did it say?0 -
Have you checked the Plan and found the area in blue?ChloeLangford wrote: »My lease states "5. The exclusive right to park a private motor vehicle in the car park parking space no. 22 in the basement of the building and coloured in blue on the plan no. 3 annexed hereto."
If the lease clealy includes a space, then wite to the Manco, with a copy of the lease, refering in your letter to the relevant clause, and ask them to ensure the space is designatd for you.

So after contacting the Managing Company last night with a copy of my lease they have responded today with the following:
It seems that on Land Registry this garage space still belongs to the Freehold Company which is why on our records that is a free space that belongs to the Freehold Company.
Although, as agreed with the Directors this space does belong to Flat 22 and you have the right to park your vehicle in the space, although please note any vehicles in the car park must be kept in a good working condition and be MOT!!!8217;ed and Insured.
So I have got my space even though it is currently numbered 31.1 -
Good result!
For the reasons in post #28 I wouldn't be in any hurry to have your flat and parking bay number the same.0 -
Yay!
To save future hassle when you come to sell the flat eventually - then get all relevant paperwork updated to change "22" to "31" - so you don't get a future buyers solicitor asking where the space is.0
