TV Screen damage within 30 days, bit no box damage.

What did you buy?
LG 49" TV
When did you buy it?
Ordered 15/6, delivered 18/6, complaint lodged 15/7
Where from? (internet or in store - it DOES make a difference)
RGB Direct, internet purchase
How did you pay? (cash/cheque/debit card/credit card etc)
Debit Card
What went wrong?
Opened sealed box 27 days after delivery to find glass on screen was smashed, no damage to plastic frame or packing and box.
What are the vendors telling you?
That unless it is discovered 2 days after delivery then damage is not covered by 30 days warranty. Despite being told there is no damage to the box, casing or packaging they claim is damage and not a manufacturing fault.
What solution or remedy are you looking for? (Companies may Repair / Refund / Replace)
Refund or replacement
I can't see how it could have damaged as it has not been moved since delivery and there is no damage to any part of the item or packaging except the glass on the screen. My only explanation is that it is a manufacturing fault when being constructed placed into its packaging or it has cracked/shattered on its own accord.
It wasn't inspected on delivery as it was a present and showed no signs of damage externally.
I don't see how it can be classed as user damage when the box is fine with not even a dent.
RGB Direct are claiming that 30 days only covers electrical or operational fault which I dispute as the consumer rights say if the item is not fit for purpose and does not specify these details.

Tricky, can you prove its not been removed from the box? Can you see any impact damage? Normally in their T & Cs is specifies you should notify damage in x days. The CRA covers you but can you prove is not been physical damage?0

I had to take off the cello tape seal before opening it but there is no way to prove this.
With regards to proving there has been no damage, it's just their word against mine.0 -

You keep mentioning 'no damage to box' as if this is in your favour. If anything it makes it look more like you smashes it...0

I personally could not wait that long to open a box, am like a big kid and have to open straight away. You should of done the same if only to inspect the goods.0

What part of the screen is damaged? Near the edge or in the centre? Top, middle, or bottom?
How did you remover it from the box? Laying down flat (on its back) and gently sliding it out or reaching in and lifting it out which would need you to grip the frame (and possibly the screen) in order to take the weight and pull it out, particularly with some friction with any polystyrene?0 -

It seems a strange way of asking for help with a question first and the the OP puts in his/her answers. It may just be me.
It has been stated so many times on MSE that the buyer should inspect deliveries ASAP as leaving then unchecked will only cause issues down the line if the item is found to be faulty and they wait weeks, months to find the item they bought is broken/damaged.

It just shows that OP has read the sticky threads at the top of consumer rights, they have used the preferred template which asks the most important questions so we have a better picture to start offering advice rather than 10 pages of us asking for clarification before being able to help.

I don't recall seeing that many threads using that template layout but as a long time user i must of missed them all.0 -
How was the tv stored? Laying flat would damage it.
How as it handled? The tv could have been twisted slightly when lifted0
