Please could someone help me with my defence for county court against CEL?

Would it be a good idea to put in "The Defendant is prejudiced and is unable to prepare a full and complete Defence. The Defendant reserves the right to seek from the Court permission to serve an Amended Defence should the Claimant add to or expand his Particulars at a later stage of these proceedings and/or to limit the Claimant only to the unevidenced allegations in the Particulars."

Just to cover my back incase they do go to court?

No.
They wont go there, and you already have as full a defence as you need. You are not liable, they cannot make you liale, they know this and I would be AMAZED if they did actually turn up.

Except that as 22nd July is a Sunday you have until 4pm on Monday 23rd July 2018 to file your Defence.


When you are happy with the content, your Defence should be filed via email as described here:

1) print your Defence
2) sign it
3) scan the signed document back in and save it as a pdf.
4) send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
5) just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.

Hi,

So i have sent in my defence, how long should i wait before I check it has been received correctly.

I have an automatic response saying that they have received the email, i am just worried that if they have issues with opening the attachment.

6) Check with MCOL that they have logged your defence. Log in and see if the claim has been recorded as "defended"

Check on MCOL from time to time.
It should change to 'defended' after a few days.

I have checked MCOL and it says in the status summery that my defence was received today. So I am just hoping that means that the PDF was OK.
Now I guess it is a little bit of a waiting game to see what happens next.

I am pleased to say that CEL have discontinued the case against me. They didn't pay the court fee.

I would like to thank all of you for your help. You have helped me stand up to this monster and encouraged me to defeat it. I am truly grateful!
