Debt Collector Chase for Paid PCN

Hi

CPS Midlands have passed on a PCN to a debt agency for collection that I have already paid. I have the receipts, email etc from the payment. Three months after paying letter drops you owe the fine and now costs.

I have contacted them and the debt collection agency but still not received any response (surprise surprise) They all seem to be a law unto themselves.

Is there anything I can do to basically retaliate? Can I take them to court, charge them for my time needed to rectify or something akin to 'Obtaining Monies by deception' Theft/fraud act? anyone tried or succeeded in something like this before or have any insights.

Its about time a stand was taken against this sort of behaviour!

Thanks

Your day will come when you get the PPC zapped in court
and it's anyone's guess if they do that.

If you get one of the trashy legals contacting you,
as seen on here, come back here.

In the meantime, it's out of your hands and is now
in the cloud nine scammers world

You could try complaining to the IPC. I wouldn't be surprised if they sided with the ppc though.

Not a lot. you could sent them a letter before claim for a data breach, but such claims are difficult to win. Try your MP

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

Hospital car parks and residential complex tickets have been especially mentioned.

The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

and complain in the most robust terms to your MP. With a fair wind they will be out of business by Christmas.
You never know how far you can go until you go too far.

Thanks all - as I expected even if I tried to turn the tables it would be fruitless.

Hmmm. Data Miss-use- release of personal data to third party for no valid reason as it had been paid- possible a good one to the ICO.

Keeping everything and will claim harassment if they continue anyway.

I have put a complaint into the body they are supposedly affiliated to. IPC but looking at the comments here almost a pointless exercise.

Query was not about the stage but about retaliation/table turn

No harm in a complaint to the ICO, the more the better

Let us know what rubbish you receive back from the IPC
  • Quick Update :

IPC have requested copy of debt letter and also copy of proof of payment - hmm will they actually take the parking company to task?

Response received from the parking company - 'Genuine honest mistake' that the payment was not assigned to the ticket as it is a manual job, and it was not an attempt to gain money by deception.

Well my parking was a genuine honest mistake as pointed out in my appeal that was rejected (basically fined for parking at a club I was a member of, but parked in a none to clearly marked high vehicles section)
So by my reckoning I will invoice them for my time to sort their mistake as they did with me.

I hope you realise that you had no need to pay these scammers, and will come here first if you get another PCN before doing anything.
