PCN for 32d, City of Westminster

Hi,

I received a PCN by post by the City of Westminster back in April 2018 (£65 discounted and £130 full penalty). The contravention was 32d, failing to drive in the direction shown by the arrow. The date of contravention was 2nd April '18 and the date of PCN was 5th April 2018. I made an appeal to the City of Westminster on 15th April which was rejected on 24th April. I still had 14 days to pay the reduced penalty. However, I knew that this PCN was unfair so I decided to appeal it with the London Tribunals on 5th May. On the day of the hearing that was 14th June London Tribunals adjourned the case and an email was sent to me on 15 June that "it appears to the Adjudicator that the Council evidence currently available to him for this appeal has been mixed up with another case." The case was decided to come back into the list for decision on the 5th July '18. on July 8th, I received an email saying that the Adjudicator has refused my appeal. In addition that letter says "It is the full penalty charge which is payable as the Adjudicator at the adjudication stage is unable to reset the initial discout that was offered for acceptance of the penalty charge and prompt notice.

During this entire process, I received no notification or notice to owner from the City of Westminster that I would be responsible to pay the full penalty if the case with London Tribunals is rejected. Then without prior clarification how can they charge me with full penalty? Also isn't this discouragement of my rights to appeal against unfair PCNs?

Please let me know if it is a common practice to pay full penalty if the appeal fails the London Tribunals stage

Have a read through some of the other threads there before you post your own to get the hang of what information they need from you in your opening post - but as a minimum you will need to post redacted photos/scans of all correspondence you've received from the council (both sides, if appropriate) as they need to see all the small print.

PePiPoo has an excellent success record in dealing with council tickets.

PS - try breaking up your posts to include more paragraphs. It makes them easier to read. Regulars are reading up to 70 threads, with numerous detailed posts, every day of the week, so a wall of text is likely to be either totally ignored, or glossed over with a danger of incorrect (and potentially expensive) advice being given.

You will get nowhere. This is the case with all PCNs, always has been since I can remember.

It is made clear on the postal PCN that the penalty is always the full amount, and that the discount is purely that. We call it a bribe not to appeal. It disappears if you carry on, and is never in play at adjudication.
