ins claim fiasco can i claim

Hello

my wife had an accident suffered head injury
police said just give this number to them they can get report.

my wife unfortunately called to give them the Number...
what follow was this

guy on phone kept wife on for an hour. she was in tears just asking if she could give them accident number off police. he kept asking questions she begged to give number he would let her go until he got every thing off her which information she gave was wrong anyway which caused more problems

yes I KNOW WHY DIDN'T SHE HANG UP because this was 5 days after a head injury and she didn't know what she was doing.
then came courtesy ins told her they would sort it...
phone ring wife answered then a man talking about courtesy car made her go through the accident all over again, she was in tears on phone again saying she suffered head injury again wouldn't let her get off.

because they made her give info which was not right they refused me a courtesy car which i was entitled to under ins anyway. I should say this was a company the ins co. gets to supply cars

then she has legal people ringing in tears she said she can't do it go throught accedent details they ignored her then the physio rang and an hour at a time

the legal was passed on from ins co. It has left my wife terrified to talk to anyone at the mear mention of the accident and she has to deal with flash bck still after two and half years...

sorry to go on so much don't know how to state any of this briefly


my question is can i get comensation of my insurance for the emotional horror they caused her?

please any help welcomed

    The insurance company would require details of the incident just giving them the police number isnt enough unfortunately .


    I doubt if you could claim anything but if proven they didnt handle things appropriatly she may be able to !

    Police reports are invariably heavily redacted, cost the insurer money to obtain and can take up to three months depending on the force and time of year. They would also require your wifes signed consent in the relevant mandate before it would be issued, so it is not as simple as passing them a number.

    They will need to (and have a right to) go through the claim with their insured to take their account of the event to determine if the incident is covered under the relevant policy.

    I work for an insurer. I sent the police a letter in November and am STILL waiting the police report (they have a HUGE backlog and are still only working on letters received in August last year - they can literally take forever.

    You're usually only entitled to courtesy car if your car is being repaired, if it's a total loss usually you don't get one unless you pay extra.

    Your wife's insurers would have sent an instruction to their legal company so she can claim for her injuries... and she would need to go through the circumstances again as they need to send a formal claim to the other insurer.

    If this was all too much for your wife, could you not have just spoken to people on the phone instead?

    thanks for all your comments.. problem was all this happened when i was at work... another problem is she didn't know anything has no memory of what happened and fireman got her out and into ambulance... at the meer mention of the insurance company, solitors she changes gets very agitated. not a day goes by she doesn't think of the accident. she is now just a reck and not herself..
    I did try to talk to these people who was arranging car ( for some reason not the insurance ) they completely refused to talk to me this was the attitude of everyone... she had a swollen head for 3 months she cried and begged to the insurance that she couldn't talk on phone and they completely had no regard for her injuries... they were not sympathetic as they all claimed because the insurance never comunicated with anyone..they just kept her on the phone longer...
    amazing isn't it damage anything in the house and their on the doorstep.....

    When you are involved in a claim for injury you must start the claim within 3 years of the incident (or 3 years from when you discover the injury is linked to the incident)


    So she does need to pursue the matter now (assuming third party was to blame for the incident)


    If she had legal cover with her insurance at the time see if they can help, or if she is in a union try them, otherwise contact no win no fee
    specialist firms

    Regarding the complaint about the way her insurer dealt with her, did she complain at the time (if so it may be too late now to seek compensation off them by way of escalating the complaint to the FOS)

    Whose insurance is the claim on- hers or yours.

    When my husband had a claim on my insurance as named driver the insurance company dealt with him for information about the incident but all other communication re courtesy car etc was done with me.

    If it was your insurance why were they not talking to you?

    If it was her insurance then why would your insurance be paying anything to you?

    thanks wifey was a named driver on my policy. The police is done. The third party was taken to court fined for driving with out due care etc... no one has ever contacted us. we were ringing police for over a year
    then last march I think when wifey phoned police yet again she was told it went to court and they asked her didn't you received the paperwork clearly wifey said NO then it was quite on other ended for quite a while she said.... had a brother in law who said police have to contact you well thye didn't ....

    If she wants to make a claim for injury she needs to go to a solicitor within 3 years of the accident. She needs to tell them all the details she knows of the accident, and what is wrong with her - otherwise she can't claim against the third party.
