and i totally forgot about cancelling the insurance. £160 was taken today. Is there any chance I can claim this back as I have no car to insure. I am with quote me happy and they do not have a call centre so thought someone on here might know if im legally entitled to the money back.

Thanks

check your T&Cs as i believe you have a credit agreement with another company to pay monthly and it may depend on what that says.

Call them up and cancel it, see if they will back date the cancellation date. Chances are you would of had to pay the £160 anyway after cancellation fees and admin.

Legally you paid for a service and received it, doesnt matter if you needed it or not.

No different than buying a bunch of bananas and throwing them away because they went bad.

Is that a monthly payment of yearly? If its monthly i suspect you can only stop payment going forward (paying a cancellation fee) if its yearly, you might be able to get the remaining months refunded after paying a cancellation fee.

Difficult to call if they do not have a call centre! There must be some way to get in touch - after all you did manage to buy the insurance in the first place.

I used to work in insurance, if you contact them with proof (i.e. the slip you get from DVLA to confirm transfer of ownership) they should backdate the cancellation to the date of the slip. as there was no insurable risk from this date, they can and do backdate.

£160 as in a normal monthly payment or £160 as in a renewal?

If it is a renewal you have a 14 day cooling off period where you can cancel for a refund. If it is a normal monthly payment that money has gone as it has been correctly taken due to the policy still being live because you've not cancelled it.

Even though the OP no longer owned the vehicle, if there was a policy in place for it then the insurer is still legally obliged to pay out if the driver had an at fault accident even if that driver wasn't named on the policy.

If you do a search on Google you will find a few examples of where this has happened:
