Claiming from easyJet

Our flight home in July 2007 was diverted from Liverpool as a result of suspected terrorist action. The promised coaches to take us to our expected destination did not materialise and the Captain told us to make our way home and send easyJet the bill. So far they have refused. I was wondering whether anyone out there had been successful with a similar claim.

Have they refused to reimburse you or just not replied?
Write a letter before action to the company's registered office.
Give them 28 days and then go to Small claims (it can be done online).
Have you got names and addresses of other passengers in the same boat so that you could pool your resources and start a class action?
Last point have you claimed for this against any travel insurance you may have had?
I would imagine that you would still need written confirmation from Easy Jet about the circumstances but it might be an easier way to reclaim your expenses.0 -
'Terrorism' is usually in the long list of insurers get out clauses. Try customer services again and if still no joy then small claims sounds like a good bet. Check also the booking terms and conditions..they entered into a contract with you to provide a service from A to B. What are the exceptions to this?
Usually Easy will pay out for legit claims. They often need a little 'persuading' first though.Timmay!0 -
Terrorism is indeed a get out clause - but only for cancelling flights - not for diverting in mid air (I presume this is what OP meant).
If they drop you off at another airport it is my opinion that they are in breach of contract unless they take adequate steps to repatriate you to your original destination (or at the very least come to an arrangement such as what happened to OP).0 -
Thank you for your replies. Just to clarify things, the flight was from Barcelona to Liverpool which diverted to East Midlands arriving around 12:30am. They had promised coaches to take us to Merseyside but these had all been utilised by earlier flights (not their fault). The Captain made this announcement whilst taxiing at E Mids and told us to make our own way home or get a hotel room and charge it to the company. easyJet has replied but refuse to pay me and refer to their terms and conditions. You are spot on ejones999 they do have a right to take us to/near our original destination as per their T&C but nothing is mentioned re claims for re-imbursement.
We managed to get home after telephoning my daughter who drove to E Mids in my car. The fuel tank was full and therefore no fuel was purchased specifically for the journey so no receipts exist. I claimed a token 25p per mile. easyJet say they will pay £7 per person on provision of receipts. There is nothing in their T&C about receipts nor any limit of £7.
I do not know the names of any other passengers, which was one reason for coming here. I have now written to the CE and failing a reasonable outcome will try small claims as suggested. Sorry this is so long.0
