Equifax won’t remove the defaults

Hi
Today was my 6 year anniversary of my bankruptcy, Experian and call credit have dropped these of my records and even though I know credit scores don’t count it’s good to see mine back up to 991. The problem lies with Equifax who haven’t removed any I have rang them and they have told me the creditors have to give them permission! I have told her no permission is needed as this is law, they have told me I have to dispute them all and all could take 30 days !!!!!!
I have told them I want it removed today as I want to move in with my life, has anyone got any information which could help me move these on?
I have recently contacted them to let them know this date and still it’s not off. I have also 3 times sent them my discharge certificate

    Why not try doing what they advised?

    Or try a little patience.

    They probably didn't have it marked on the day of your bankruptcy

    Give them 45 days and if it's still there then is the time to start making some noise

    Equifax can only update things based upon the information the creditors give them. First you need to check that the information from the creditors is correct on your equifax report.

    Do any of the debts show the defaults? What date are on these defaults?

    Dates on defaults are 09/07/2012 which makes it my 6 year anniversary and by law they should automatically drop off

    Probably easiest to ask the creditors to do it...
  • As already advised - the CRA's only report what the creditors tell them.

    So they need to instruct Equifax to remove them

    If you feel you have the law on your side why aren't you pointing them in the direction of this law (rather than seeking advice here!)

    This is actually complete nonsense from whoever you spoke to at Equifax, but it is not quite the issue here.

    Experian and Callcredit drop defaults automatically at the 6 year mark (sometimes a bit before on callcredit), and they do not seek 'permission' to do so. In fact, the lender cannot prevent them doing so, unless they choose to falsely alter the default date.

    Equifax just do things differently, in that their reports do not drop the record 'live' on exactly the 6 year date, but can take a matter of a few days to a few weeks to do so. While this may be a really 'cr*p' way to run things, the ICO etc don't seem to be overly bothered by such delays as long as it is just a delay, and not a complete failure to remove.

    Practically, by the time you make the effort to complain to Equifax about any delay and get a response, in all but a tiny fraction of cases the record will have dropped on its own by that point.
