Garage Services
The first week in May I put my car into a local family run garage as I had a power loss problem and the Mazda Dealer has no available workshop slots for theee weeks, I need my car for work as I am a taxi driver, so took it to BMW specialist. I was told I needed a new turbo, so went ahead and had an After market replacement fitted, also had a service at the same time. A couple of days after I had paid £2400 for the work the car started smoking, from this point on the garage were at a loss I think.... I took it back and a six inch bolt simply fell from engine covers! Turned out to be for DPF housing!
They could find no codes so sent me off again, the problem continued, they found a code relating to ERG valve and cleaned that, car ok for about 5 miles then more smoke!
Through all of this the Turbo has been whistling excessively in my opinion, but was told they are meant to whistle!
After having numerous visits to the garage, they tried adjusting various components to no avail... I insisted they had it tested by dealer as a friend works there and they got car in as a favour, this would have been a three to four week wait for me... anyway Mazda said turbo has an overboosting fault. So another turbo was purchased from Mazda and fitted... well almost fitted by Garage... sorry they said... turbo still overboosting and we don’t know why..... Car now in Main Dealer again as I think Garage have given up!
So two months later and still no solution.
My question is are the garage liable for any out of pocket expenses I have incurred and loss of earnings?
I have spent £700 on temporary insurance cover for hire vehicle so I can still work, as have lost so much time of fun of work due to having no car.
Vehicle hire cost, and loss of earnings now around £2000
Will all repairs after initial payment for turbo replacement be down to the Garage ?
Does this mean I will have to take the case to small claims court ??
No other codes were shown at initial diagnostic other than turbo under boosting, which was a deflector disc had fallen out of its housing between the twin turbo assembly.

I can't see them being responsible for consequential loss unless you can prove on the balance of probabilities that the garage was negligent.0
