PPI Advice after divorce

Hi there

So to cut a long story short, back in 2004 I took out a home owner loan which had ppi, on top of which I was then sold bill payment insurance to cover the cost of the payments (which were already covered) so I recently put a complaint in to Halifax and it has been upheld....hurrah !

I am also divorced (and have been for the last 5 years) when I took out the original loan it was in joint names however, as part of the divorce there was a clean break order where I took on all of the debt, the house and kids and my ex got a lump some of equity out of the house in return,

Now, the wrinkle comes in that because the original loan was in joint names, Halifax want to split the payout between both of us 50/50, I'm not happy with that as I have been the only person to pay into this policy (which shouldn't have been sold to me anyway) and for the last 5 years while we've had that financial split in place the policy has still been running during this time and been paid into throughout so even if I do have to split it, in my view the percentage is incorrect.

The question is, since I have a clean break order, what are my rights to dispute a split payment ? or at worst dispute the 50/50 percentage of the split ? (as I've been paying into it for 5 years 'post clean break' where she has not been a part of my life, does she have any claim to the refund on payments made during that time ?)

Any words of advice anyone has would be greatly appreciated

    Halifax are correct in what they are doing. However, you are free to bring it up with your ex and possibly your solicitor if she does not cooperate.

    No dispute rights with the Bank, but plenty with your ex-wife I imagine. ;)
