Premier Parking BW Legal

Hi everyone
I have searched all over the threads and due to there being so many different questions and answers it is hard to find a specific answer to my case so apologies for the new thread.
Today i received a letter from BW Legal in response to an alleged offence which occurred at the Athenaeum Plymouth on the 25th September 2012, I was driving my company vehicle at the the time and clearly bought a ticket and put it on display and the next day went to renew the ticket and there was a penalty notice on my window. this is the email I sent to Premier Parking at the time on the 28th September 2012
"Good morning
I have just return from a business trip to Plymouth,
I arrived in Plymouth on Monday 24th Sept and parked on the Athenaeum Car park with the Ticket machines DER1 and DER 02, I purchased a 24 hour ticket from DER 02 which has an expiry of 16.49 25 Sep 12, I returned to the car park on the 25th of Sep to obtain another 24 hour ticket from DER1 which has an expiry of 16.46 26 Sep 12.
As you can imagine I was taken aback as approached my vehicle to replace the old ticket with the new one to see I had a penalty notice timed at 14.50 attached to my drivers window even though I could see the current valid ticked from afar.
I have attached a photo of the 2 purchased parking tickets which clearly show no break in time and also the penalty notice.
You're response and help on this matter would be appreciated."
I attached a copy of both my parking machine tickets and the penalty notice.
I then receive a letter from them in the post which i do not have anymore due to it being so long ago but this is my reply on the 15th October the day I received the letter.
"Hello
I am writing in reply to a letter I received from yourselves regarding the issue of not cancelling the parking charge notice, in your letter it states you received my email on the 1st of October however of was sent on the 28th of September so please do not try to tell me it took 3 days until your staff looked at the email! secondly it states that "as you can see from the photographic evidence attached" again there was only the letter in the envelope and nothing else.
It is ludicrous that this fine of £75/£100 is expected to be paid when there was valid tickets lasting in total 48 hours at a cost of £12 which I have already emailed copies over to you of.
I look forward to your speedy and positive response before I am forced to report this matter to my local MP and the local MP in Plymouth"
As you can see from my response they did not even attach any photo evidence and that was the last contact we ever had until today.
Any advise on my next steps or how to approach BW Legal would be greatly appreciated,
Thank you, RB

Everyone is politely asked to read up on this in the newbies faq thread near the top of the forum before starting a new thread
Go there now to learn about the game you are now caught up in
If the letter you just received is a lbcca, then read up in the newbies faq thread (#2) on how to deal with both the letter and any court claim
If it is not a LBCCA but a debt collecting attempt then read #4 in the FAQ0 -
I would send them a SAR (not BW Legal, Premier Park). Ask for all data held, then complain to the ICO about their misuse of the ticket data, if as you say the car was covered the whole time and the tickets are shown in the windscreen in the photos.
Your case is like this one, from August 2012, and you too need to engage BW Legal in some letter tennis for a few weeks:
https://forums.moneysavingexpert.com/discussion/5865237/may-have-made-a-mistake
You have both been picked on because you both blabbed about who was driving...PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
CLICK at the top or bottom of any page where it says:
Home»Motoring»Parking Tickets Fines & Parking - read the NEWBIES THREAD0 -
Great thank you0

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.
Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct
Hospital car parks and residential complex tickets have been especially mentioned.
The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

and complain in the most robust terms to your MP. With a fair wind they will be out of business by Christmas. You never know how far you can go until you go too far.0
