that solicitor is duty bound NOT to discuss her cases (never mind the GDPR) and MSE would probably ban her if she started to advise people in a legal capacity, plus SHE was educated by US when she got her first ticket, so I would think that her day job is in a different capacity, like conveyancing or employment law or legal aid or wills & probate etc etc

I am thinking that you are on the wrong forum here due to you asking legal and complex questions and expecting legal advice about those questions, putting others on the spot where they should not be

this isnt a legal assistance forum, you want LEGAL BEAGLES or CAG for that, as it says in my signature

on a personal note, I havent seen anyone of note in the legal department post on here this month, certainly not in the last week , apart from maybe one or two consumer rights advisors and LOC123 has made a few (a very few) posts in one or two interesting cases

in essence, your expectations outweigh what the volunteer members here can and will do, or are allowed to do under forum rules or GDPR or the law

you dont see MARTIN LEWIS offer counselling or legal advice for the same reasons, because there comes a point where only a paid professional can or should be doing it which is why he uses THEM to answer complex legal questions or counselling on his programmes etc, Watchdog and RIP OFF BRITAIN etc also use legal advisors , qualified solicitors and accountants etc to do the same things, its not Matthew or Gloria or Angela or Julia that give out that advice !!

    good luck

What don't you like about this idea?...
blow BW s legal brains one , get daughter to write letters to britannia AND BW stating that she wishes to cancel the contract she entered as a minor
    I think it's brilliant.

I do like a good argument sometimes.
    If only we had time!

Why not take up some of the burden, because there's a number of posters who equally like 'a good argument'. You have an academic debate with them while regulars deliver good practical advice to those who will take it and work with us.

A good combo in the making!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Thank you for your opinion, but you've got the wrong end of the stick here.

Me? Nothing, which is why we've already written to Smart Parking and their skivvies DCP stating exactly that, and will be responding to any solicitors in the same way! (FWIW - I don't know what Britannia and BW have to do with this at this point).

I do not believe I have

once this thread delves into the legal aspects of the law then its not for this forum

this forum is (or used to be) about PRIVATE PARKING CHARGE NOTICES and appealing them to the Private Parking Companies , POPLA and the IAS (or not)

its PARKING TICKETS , FINES & PARKING

it rapidly descended into debating debt collector letters

and now has sunk even further into the mire of legal aid with almost every thread about a court case or an LBC before a court case

B W LEGAL handle BRIT alleged debts (invoices) and LBC,s just prior to court cases

you need to remember that those of us who have been here daily for 5 years have an accumulated knowledge about this sc@m industry and know where these things are heading and which legal companies and debt collectors are associated with which parking companies

if you have questions about a pcn that the volunteers can help you with then feel free to ask, but once it goes past the initial appeal and popla stage this forum isnt really set up to help with few qualified advisors who have to watch what they say and how they say it because if they overstep the mark the forum bans them (hence why any solicitors or legally qualified members here are cagey in their replies and give out caveats that it is not a professional legal advisement that they are issuing, just a personal opinion

you can count the number of regular advisors with a legal background or experience who post on here on ONE hand

post #4 of the NEWBIES thread deals with debt collectors like DRPL because this forum isnt about debt collectors or bailiffs etc

I havent seen any evidence of not so SMART rejecting the appeal and issuing a POPLA code, so did they do these 2 things ?

if so, what happened with the POPLA appeal ?

if they didnt give a POPLA code , WHY NOT ?

and if they didnt issue a POPLA code with a rejection (prior to DRPL being involved) - complain by email to the BPA AOS team with copies of all paperwork

my thoughts ? - due to over thinking this and trying to be clever on the age issues you have lost sight of the ball in the blue text standard appeal from an RK plus the subsequent POPLA appeal which is what everyone else is told to do, regardless of age

    thanks

I have just tacked on the POPLA question , which at this stage seems more important than any age related issue
