my parked car hit 3rd party denied liabilty

hi is as the tittle reads, my car was parked in works car park and one of my colleges came in to let me know it had been hit by some guy in a van, my boss and a warehouse guy witnessed this guy hitting my car and the guy flat out denied it even though I can see where he hit my car and he has damage on his van, I photographed his vehicle and damage and got his details very reluctantly, how will this proceed, my insurance company are talking about me having to pay excess if he denies but I don't want to pay for something that's clearly not my fault, I have 2 witness's and the vehicle was stationery

If you don't want to pay your excess (which normally always has to be paid when claiming off your own policy and subsequently you pursue the third party to get it reimbursed) you should cancel your claim with your insurer and pursue a claim direct with the third party yourself
If they refuse to accept liability you will still be able to claim off your own policy, though it will be in your insurer's hands to deal with this as they think fit
(Your only other alternative is to pursue the third party (to court if necessary) yourself)0 -
I managed to get the cctv footage of the site management company now, surely if they tell his company this now, he will not have a leg to stand on with me have 2 witness's footage and the fact he has hit a parked car0

As advised, try claiming direct from the third party insurer, pointing out to them the cctv evidence you now hold.
You have nothing to lose - as if they refuse liability you can still claim off your own policy, but have to pay and reclaim your excess, and leave it to your insurer to sort out liability0 -
If this was a company van, rather than a sole trader, it might be worth speaking with the fleet manager or a director and emphasising that you have overwhelming evidence of what he is denying. Presumably he has spun them a line that suggests the liability is yours: they won't be best impressed to find that he is lying to them as well.No free lunch, and no free laptop0
