CCJ from Cabot for Orange account

Hi

We are in he process of wanting to apply for a mortgage and when checking credit scores my husband found a CCJ.

I have so far emailed the courts to find out more information and they have sent me this information via email:

Claimant: Cabot
Claimants solicitors: Restons Solicitors Ltd
Particulars of claim: THE CLAIMANT CLAIMS PAYMENT OF THE OVERDUE BALANCE DUE FROM THE DEFENDANT(S) UNDER A CONTRACT BETWEEN THE DEFENDANT(S) AND ORANGE DATED ON OR ABOUT JAN 03 2012 AND ASSIGNED TO THE CLAIMANT ON MAY 18 2015
Amount - £507.18

My husband says he has never had a contract with Orange and didn’t know about this CCJ.

What do I do now I have the information...? Do I contact Orange directly to discuss? Can I ask them to send me proof of such account... and appeal the information as fraudulent?

    All part of the same group - did he have a contract with one of these?

    Your husband needs to make contact if it’s on his files under his name.

    No he has never had a contract mobile phone. I will try orange tomorrow when he is around to give me permission to speak to them. Thanks

    Could be a mistrace and:

    - subsequent link of an already obtained CCJ to his credit file when it should not have been. e.g. similar name.
    - a CCJ obtained against your husband at a previous address due a debt that wasn't his being wrongly traced to him.

    Either way will involve a formal complaint against whoever made the action.

    Complain to EE (the parent company) and Cabot, saves time waiting for them to pass the buck.

    Why are people on this site obsessed with template letters? Just write the details of the complaint denying the debt is his and tell them to investigate. Obtain free proof of postage from the PO and ensure the envelope is clearly marked complaint

    You need to include:

    Full name, full postal address, account number and/or mobile telephone number (if this is on the CCJ and/or details of the CCJ), details of your complaint and a daytime contact telephone number. You will need to ensure that your husband makes it clear they can speak to you as well

    I am all in favour of the internet as I have used it for 20 odd years but there are times when formal complaints in writing are worth doing to create a proper paper trail

    You say he has never had a contract phone - has he ever had a sim only deal or has he ever been on Orange/EE /T-mobile?

    This is important as some believe (wrongly) that contracts have to involve a mobile phone, or be signed for, etc. People also get a phone out for someone else who will pay all the bills (due to age or credit history) without realising that makes them liable for the debt not the person who was using t or supposedly paying bills.

    The reason for template letters is because it is important to not admit liability.

    What OP needs to ascertain is what address it was taken out for - if its one that you've never lived at then its likely a mistrace. If it was at a former address, it could be fraud. It could also be a family member used OP partner's details to be able to obtain the contract (with or without their knowledge)
