Survivalservers.com Stole My Money!

My son asked me to purchase him a Minecraft server from this company called survival servers, from what i can tell they are based in the US and i thought would be a reputable company. After ordering the server which is a digital service and im not sure how the law sees these tyes of services, the server was not delivered and all messages to them via their official support portal were unanswered. There is no phone number or anything to contact them, only an online forum you must post in. Anyway to cut a long story short, they apparently set the server up three days later and notified my by email which went directly into my spam, by which time i had bought from another service online and my son was happily playing along.
The problem came when i asked them to refund the money 2 weeks later, they point blank refused and told me the service was running and usable. Where do i stand in consumer law in getting this money back. Admittedly its only $10 but its more principle of the matter.
1. I did not get the service the same day as their website suggests i will. Infact three days late.
2. The email when the service was eventually setup went to my spam folder so i did not recieve notification of setup
3. Point blank refusing me a refund when i clearly have not used the service.

UK consumer law does not apply as they are a US company.
Not sure how much fight this is worth for $10, which is about £7.60 or so.

Pick your battles ... whilst you are (possibly) morally right, the time and effort involved in chasing $10 (less than £8) is not worth it.
If their T&Cs guarantee service setup same day, then you could contact your card company and raise a chargeback as the company breached the terms. Don't hold your breath though.0 -
Reading their FAQ they do say that server creation can be delayed due to payment verification or if there are mods to be added to the server it takes up to 48 hours to go live. They also say to only submit a support ticket once as every time you add to it it pushes you back to the end of the queue which means all of the messages you sent pushing for a response actually caused a further delay in them reaching your support ticket. Add to this the fact they are in a different time zone and their working hours are going to be different to the U.K. so that could cause a further delay.
They do say that they don't give refunds except in exceptional circumstances and that they will dispute any chargeback requests if they believe they are in the right.
The fact that the email went to your spam folder is not their problem at all, they have no control whatsoever over how your email client handles and distributes incoming emails and the fact that you chose to not check there even when you knew you were expecting a response from them is not their fault or problem either.
It's $10 it's really not worth even wasting another minute on, but make sure you cancel your subscription before they charge you again next month.0
