Default notice car finance

Hi there.

looking for a bit of advice.

I have just been issued with a default notice dated the 25/06/2018.

This was sent as i have missed 3 payments. I sent them a letter on the 10/06/2018 requesting that they allow me to VT my agreement. I never heard back from them until i got the default notice. I also sent a second letter, this time via recorded delivery which included the original letter and a second letter which was also dated on the 25/06/2018.

What i would like to know is, can they default me after i have given them notice to terminate my agreement and where do i stand on a legal stand point. The problem i have is that i did not send the 1st letter recorded delivery like the second one. But both the default and my second VT letter are dated the 25/06/2018. Which takes precedent?? Anyone?

    If you missed payments while waiting for the VT to be arranged, then those missed payments take precedence.
  • The whole reason for VT the agreement was that i could not afford the payments. I gave them 14 days notice and heard nothing from them.

    I also have not paid 50% so i know there is going to be a bill down the line to pay, but right now i do not have the funds to keep ploughing into this.

    I have until the 12/07 before the account defaults so can i VT before then or now that they have issued the letter does that mean im stuck and need to follow through with the default?.

    Phone them and ask, but if you don't have the funds to pay the 50%, then you can't VT.
  • Why did you take it if you couldn't afford the payments?

    Yes if you haven't continued to honour the contract until it has been terminated.

    You owe the money, you are in breach of contract.
