Gap Insurance - claim back

We purchased a new car of PCP a few years ago and declined the Gap insurance through the dealer as found a cheaper alternative. Having an assessment of our direct debits over the weekend we have spotted that the dealer had continued to take the direct debit out despite us telling them to cancel the insurance.

They have said this morning we should have cancelled through the 3rd party but we were never given any info about them so impossible to do so.

Obviously Ill be requesting all of the direct debits back but can I also claim the interest the company would have received on my amount?

Happy to have discovered this but a reminder to check DD's!

    You can't "claim" anything I'm afraid.

    However, you can certainly make a complaint about having had two concurrent insurance policies covering the same thing. Do not under any circumstances request that your Bank refund Direct Debit payments. The refund must come from the seller of the insurance if they accept you were mis-sold.

    Do you have any evidence that you actually declined the insurance or did you simply sign your agreement to it without reading or realising what you were signing?

    The insurance was due to start in the February (with first payment then too) and we signed up in the December knowing we had a month to look for something cheaper. I have an email to the dealership confirming we wanted to cancel the insurance taking effect before the due date. Seems that wasn't sent to the insurance company so the DD's have been coming out since. Sorry my original post didnt make this clear.

    As I said, forget about the fact that you paid by Direct Debit since how you paid is irrelevant.

    You should now complain to the dealership that your explicit instruction to cancel the insurance was not complied with.

    Crucially, you must also include with any complaint proof that you had (cheaper) duplicate insurance for the period you paid for the dealership's policy.

    You should also mention that they should have told you that you needed to cancel the insurance directly with the third party if the dealership was unable to do so on your behalf.

    If you get no joy, you can refer your complaint to the Ombudsman.

    If they have already agreed to refund you, why are you going to complain twice??

    For what possible purpose?

    If you receive a full refund cheque, why would you require "future records"?

    Don't waste your time in fruitless pursuit.
  • honestly? because im hoping they will feel so strongly that they want to keep their customers happy that they will give me £50k and a free car....

    Seriously though I have a case reference, and want the note on the account to reflect why the insurance is now suddenly being cancelled from a customers perspective.
