I see it more that in even trying to set up a formal agreement for rent from the adult occupant you feel should pay is going to potentially open you up to a very nightmare tenant to whom you would then become responsible for things like maintenance of the property,correct legislation with regard to certifications for gas etc
I've no idea how much "rent " you were considering but if your ex family hate you enough it may turn into small pleasure for them to have you legally responsible for a safe environment for them to live in.

a lender won't agree to remove you from the mortgage whilst you remain an owner as their repossession would be too complex with a non liable owner in the equation

Is her self-employment a proper reliable business, or making jewelry and selling at boot sales?
It is not true that courts now forcibly impose the nrp to continue to pay half the mortgage until the youngest child is 18. The judge will consider mainly the impact that selling the house would have on the children.
So the question is: if you sold the house, could your ex be in a position to get any mortgage that would mean housing your children appropriately (needs of the oldest working child is unlikely to come into it)? If so, then you might find that a judge rules in your favour if indeed, you can evidence that you won't otherwise be able to get your own property for 15 years and you can evidence the negative impact of this on your kids.
You do need legal advice on the chances of an order of sale and the likely cost of it.0 -

2. Do you know how long she has moved in for? ie she might be a uni student and only be back for a short while or some thing similar to this.
