First Anniversary First Post
Hi everyone,
I purchased a car from a dealer a few months ago. 2 days before the 3 month anniversary the car had a gear change issue and it limped home.

When i purchased the car it came with a 6 month RAC warranty.

I contacted the dealer and was asked to get in touch with the local garage to arrange an appointment. The earliest appointment was 2 days later - the 3 month anniversary of the car.

The vehicle still needs to undergo analysis and is in a queue to be seen, but can anyone clarify what my position is?
Can I still return the vehicle as unsuitable? Its a £15K car.

Its some form of electronic gearbox, or gearbox issue and there could be costs at up to £2-3K at a specialist, or up to £7K at a main dealer.

I'm wondering whether I need to seek legal advice on this matter?

Anyone know who is liable for the repair costs?

Please help...

You haven't had the vehicle diagnosed yet.
Lots of factors, age and mileage of the car, the fact it cost £15k means little at present.

49750 miles approximately. Service history and stamps present.
    March 2015 registered car.

I don't mind having them fix it (rather than return). But wondering if I have any other rights.
I don't want to be contributing to a bill when I have other courses of action.

The dealer mentioned using warranty. I thought there used to be a 3 month return of goods act for cars. It might have changed. Fingers crossed its all good, but I have to wait a couple of weeks for the diagnosis from the specialist. There's a queue apparently.

I've driven the car for about 1,500 miles. Likely less. Then this happens :(

Still pretty meaningless if you want any valid comments:
Make? Model? Engine? Type of gearbox DCT / DSG / ???

The manufacturer may offer a good will contribution from 0-100%, service stamps ?? The gearbox service at 40K/5yrs is an at cost optional extra, just like the 2 yearly brake fluid change.

I think they made a quick call to the manufacturer. I didn't get too involved, but it seemed like a 'no' when they called the Ford people they knew.

It could be that the diagnosis has to happen first, but I think the cost more than doubles if the manufacturer attempts to fix.

My preference is for the dealer and warranty company to sort it themselves, but past experience of warranties is that they try to limit pay outs.

That's why I'm wondering what happens with 3 months act etc.

It's for you to contact Ford UK and see what they may offer, but the fault has to be diagnosed 1st, but I read the Ford version of DSG hasn't been up to much.

There is no 3 months act. You've had it long enough that under the CRA you have to give them the opportunity to repair the vehicle and replace it if they can't and you can only reject it for a refund if they're unable to repair it or replace it.

At the moment you're jumping the gun and panicking over something that has yet to even be diagnosed as a four figure repair, let alone whether or not it'll be covered.

    Thanks DUTR and Tarambor!
Admittedly, I am jumping the gun. I'm just trying to chase this stuff up as will be stuck for 2 weeks with no car and a 2 month old baby and there's not a lot nearby.
The dealer has no courtesy cars available at moment.
I just don't want to find that they look in 2 weeks and then have another 2 weeks for extensive repairs or something. I'm hiring a car in the meantime.

Thanks for the CRA clarification. I just don't want them trying to push the heavy bills onto me to pay so prefer to be armed with at least a basic understanding.

I'm looking for a fair deal for all parties, without being taken to the cleaners. If you get what I mean :)

Have you contacted the warranty company?
I would suggest making sure you carefully read through their terms and conditions along with how to make a claim.
You wouldn't want them declining a claim due to not following some arbitrary procedure!
