New guarantee under refund & replacement.

Hi guys. I buy tools from Screwfix for work and bought a Titan heat gun with a 2yr guarantee over 2 years ago. I have taken the original, and the replacements back about 5 times in this period and had them replaced FOC. However, once it passed the 2yr mark I had no claim.
After seeing other questions on this and other sites, I wonder how the law stands when the retailer (screwfix) offer a refund receipt (which happens each time) then supplies a new product. Because they have 'refunded' the returned product can I claim a new guarantee?
I know that if a retailer replaces a product without refunding, the first warranty applies. But is this the case when a refund receipt is issued?
The heat guns are only cheap so I am not unduly worried, just curious about the legal stance.
Thanks for reading.

Who is giving this warranty ??
Buying for work that would be a business to business transaction and not the same as consumer law in some regards .

Are you buying as a business or consumer.

Are screw fix refunding and are you buying the item again under a separate transaction? Or are they exchanging and offering a new "receipt" for the original transaction?

In my experience, Screwfix refund the original transaction then charge again for the new item, so in effect a nil cost transaction but it could be argued that as it's a 'new' sale, a new guarantee would apply?

Well you buy Titan so you only have yourself to blame.

So are you trying to say that someone's statutory rights vary depending on the make of goods purchased?
If not, what exactly are you saying?

Presumably that they make poor quality products and people should know this. But that certainly wouldn't affect their statutory rights.
  • Thanks for the replies guys.
Firstly, I am buying for company use but I didn't think this would affect my statutory rights.
Secondly, each time I took the faulty items back I was issued a 'Refund Invoice' which credited the cost, and the item was exchanged for a replacement which was purchased using the credit.
Thirdly, I buy Titan products for the price. I find that the brand name doesn't make them any inferior when used in a factory environment.
So I suppose if I took the item back after they have exchanged it a couple of times and asked for a cash refund, I could then make a new purchase of the same item, thereby getting a new guarantee!

A refund/resale is done in one transaction two invoices are issued but its not a seperate transaction . The fact you have had it replaced five times in two years suggests you arent using the correct tool for the job , Titan is entry level tools for basic diy jobs maybe upgrade to a better model .

No retailer is going to just keep endlessly replacing tools that would effectively be just hire purchase !
