                    Hi,
My daughter received a PCN from MET Parking services in relation to the Macdonalds at Gatwick Airport as the keeper of the vehicle. I appealed before I found this thread so may have done something wrong and they have just rejected it and I!!!8217;m not sure what to do next (other than submit a complaint to McDonalds themselves through their website which I have just done)
The situation was the driver went through the drive through but sat in the car park to eat. When the driver tried to get out the barrier wouldn!!!8217;t lift so he/she pressed a button expecting to speak to someone to find out what the problem was but the instead the barrier lifted and he/she carried on thinking nothing of it. He/she then got a PCN dated 13 June (the actual incident was 18th May) saying the car had exited the car park without the ticket being validated. To me letting someone leave a car park when their ticket doesnt work so you can then fine them is simply unethical and I have pointed this out to both them and macdonalds but I!!!8217;m not sure what to do next now they have rejected my appeal saying their is no further right to appeal so any help would be gratefully received.
Thanks

Edit that first post to remove the identity of the driver.0

You appealed to MET. Have they actually said you are not entitled to a secondary appeal?0

Hi. Sorry it does say we’ve reached the end of the internal procedures and then gives a payment slip but over the page I hadn’t noticed there was another paragraph about appealing to something called popla - I assume that’s covered on this forum somewhere. Apologies for the confusion0

Indeed it is.Itsallgonepearshaped wrote: »...there was another paragraph about appealing to something called popla - I assume that's covered on this forum somewhere. Apologies for the confusion
Your daughter needs to read post #3 of the NEWBIES FAQ sticky thread to discover the best way to compile a PoPLA appeal.
There are plenty of threads on here about MET PoPLA at Gatwick.
Your daughter should use those bold words in the forum's search facility to find a ready written appeal text.0

Thanks. I’ve seen a couple of things on the threads saying they’re supposed to raise the charge within 14 days of the alleged offence - the notice she received was a lot longer than those 14 days - do you know if this is still valid to use as an argument against them ?0

All that talk about 14 days is fully discussed in post #1 of the NEWBIES FAQ sticky thread.
But in a nutshell - it does not invalidate their claim.
Your daughter should read post #1 of the NEWBIES FAQ sticky thread for further detail.0

Has your daughter asked the reastaurant manager to get it cancelled?
This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.
Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct
Hospital car parks and residential complex tickets have been especially mentioned.
The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

and complain in the most robust terms to your MP. With a fair wind they will be out of business by Christmas. You never know how far you can go until you go too far.0
