Buying - ‘private garden’ turns out to be shared green

    I agree with others, while there may be no issue now with the current neighbours, who knows who might move in next.
    Personally, having bought a flat in a Council block, where around half the properties are still council owned, I would not do it again. The turnover of tenants can be quite rapid, and there have been some real characters moved in above my flat who have caused no end of issues for my tenants below. Best of luck.

    thank you for the replies. The solicitor is pursuing the council, hopefuly it wont hold up the sale too much but if it does I may have to withdraw. It is a small sheltered housing bungalow in the neighbouring property, so wont have a large family in there at any point, but I dont feel comfortable going ahead without this being sorted.

    Make sure you get it sorted before you buy. We are going through a nightmare similar situation just now in Scotland.

    We bought 3yrs ago with a shared path at the side of the house, a driveway was built 16yrs ago on the shared area & both households used this driveway.

    I used it for approx 2yrs. Then the upstairs neighbour sold to an obnoxious woman who thought the whole driveway was hers(including the shared area).

    We have been fighting this for 18mths through solicitors but it is coming to an end now. We will be out a fortune because some ill informed person thought she had sole use of the shared area & wanted us to stop using the driveway(shared area).

    The title deeds clearly state there is a shared area but I still had to engage a solicitor to fight this. In the end it means no one uses the driveway.


    Lesson learned, never buy a property with anything shared.


    Just be careful & walk away if it is not sorted.
