Compost delivery damaged pavement outside my house

Hi, I bought some bulk compost online and it was delivered yesterday. There was just 1 man trying to offload and push the bulk bag with a pallet trolley. He could barely manage to move and turn it and was asking if there were male neighbours to help(!) He didn't seem prepared for how heavy it was.

The entire width of my driveway borders a public pavement and has a lowered kerb. The pavement and my driveway are tarmacked. There are no access issues.

In trying to push the pallet onto my driveway he gouged and scraped tarmac off the public pavement right next to my driveway. As soon as we saw the damage we asked him to stop. We had just a month ago paid to have a lowered kerb and obviously the pavement was re-tarmacked at the same time, which we paid for. Since the pavement is council property, I don't know if the council would expect me to make good the damage. Does anyone know?



The compost company has passed responsibility to the transport company they use. The transport company is trying to pass me onto a local sub-contracted transport company that they used.

I feel like I'm being fobbed off and since I don't have a contract with this sub-contractor I don't think I should be chasing them. I think either the compost company is liable or their main transport company.

I stated in my delivery notes that I would like them to deliver the compost onto my driveway on the right hand side. They're saying that because I asked for this, that they're not responsible for damage caused while trying to do so (as opposed to asking for it to be delivered kerbside). We're talking a 3m deep driveway so hardly a long distance.

They also didn't call me beforehand to arrange a delivery date and time so the guy turned up out of the blue.

Should I be chasing anyone to repair the pavement? Who should I be chasing? Will the council come after me to fix it?

    If the council ask you simply pass them the information you have such as registration number of the vehicle / name on the lorry / name of your supplier and let them deal with it. The driver should know how to correctly deliver his load, bulk bags are usually craned off with a Hiab and dropped as far onto your property as is safe.

    Whoever you had a contract with. You should only go to their third parties if it is easier, as you have been passed around go back to who you have a contract with and put pressure on.

    Of course they will and they will not entertain being asked to go to third parties.

    Councils don't have the money to deal with the vast amount of pot holes we have. I doubt they will have people walking around looking for scrapped pavements.
