Help to Buy isa solicitor issue

Hey, I've tried having a look for a similar post but can't so hoping someone may be able to help with the below please?

I've recently purchased a property and had a help to buy isa which I stated on the form my conveyancer solicitor gave to me at the beginning of the process. My solicitor never informed me of when to provide the closing statement of my Help to Buy. A day after completion I received through the post my Help to Buy closing statement which I thrn immediately scanned to my solicitor in order to claim the bonus. The closing statement had proof the account was shut a week before completion. However, I was told I couldn't use it. The solicitor assumed I didn't want to use it anymore so didn't ask during the process. What gave him that idea I don't khow!l, especially as you can only use it on your first property? Am I right to think he didn't fulfil his role properly as my solicitor throughout the process?

  • The closing statement needs to be provided before completion as that's where the bonus gets used. The solicitor will probably just say it was your responsibility to close the isa and provide them with the closing statement in good time, as per the isa regs...
  • I would double check all the t&cs / small print etc from your solicitor. All our solicitor paperwork has been very explicit that it is our responsibility to get them the closing statement in a timely manner ahead of exchange and that they won't be reminding us or bringing it up again... not what you want to hear I know but I would be surprised if there wasn't something to that effect in your paperwork. :(

    Unfortunately the onus is on us to get our solicitor's the correct paperwork in time. Solicitor's forget that even though they may have dealt with 250 HTB in last year, it is our first time and we don't know how it works. Personally, I did research online regarding them. I spoke to my solicitor regarding the ISA and then to my bank in order to ensure that the correct paperwork reached them. There wasn't anything in the solicitor's paperwork.
    Paid off the last of my unsecured debts in 2016. Then saved up and bought a property. Current aim is to pay off my mortgage as early as possible. Currently over paying every month. Mortgage due to be paid off in 2036 hoping to get it paid off much earlier. Set up my own bespoke spreadsheet to manage my money.
