Vehicle Impounded Same Day as Purchase and NO SURETY REFUND

HI Guys, long term reader of the forum but have never posted till now.

Need your help and advice please.

I purchased a car on the 1st of June. It came with no V5 so on the same day I sent off a V62 form for a new V5 to the DVLA along with the payment needed for this.

On the 4th of June, my car was impounded by Redcorn in Rainham, Essex for no road tax. In order to release my car, I had to complete and send off another V62 form at their offices which was to be posted by them directly to the DVLA. I also paid £100 release fee and £160 Surety fee which was to be refunded on purchase of road tax/ SORN once i received the new V5.

It took the DVLA just over two weeks to send the new V5. I SORN the car the same day and called up Redcorn straight away to ask for the refund of my surety fee and was told that because 14 days have passed, I can't get a refund.

My questions are 2

- Am i in any position to get back the whole £260 as the car was impounded a few days following purchase whilst my application for a new V5 was in process?

and if not

- Am i in any position to get back my Surety fee of £160 whilst being delayed in getting the car SORN by the DVLA and a new V5


Any help and advice is much appreciated.

    Hmmmm. I dont think you should have been driving it until you had the V5C / a way to tax it.

    As such, unless you can a waiver from Runcorn that it might take more than the 14 days to get a V5C and tax it, they probably are within their rights.

    So you were driving it on a public road without valid road tax?
    Then you have no case. You should have taxed it before driving it - even if that meant leaving it off road while waiting for the V5.

    Should of postponed buying it until the seller can supply a V5 or you should of waited until you received the new V5

    The vehicle was not impounded the day that you purchased it. Purchased on 1st June, impounded on 4th June. So you were driving an untaxed car for some days.

    I taxed my van at the Post Office while I was waiting for the log book.

    They have a form you fill out and the tax is valid there and then
  • The car wasn't driven at all after purchase. It was delivered to my house by the seller where it would have stayed outside until I sorted out the V5 and subsequently the road tax.
  • That doesn't work if you are declaring the car SORN in which case you have to have a V5

    But SORN doesn't work if you keep the car on the road....

    If you've declared it SORN and it's not parked off the road expect it to get lifted again.
