Penalty notice and now (late) NTK from Indigo Park Solutions

Hi all,

The newbies thread is great, and has given me a lot of info (so thanks for that), however, unless I have just missed it, I couldn't see anything explaining what to do in my situation..

I received a windscreen "ticket" on 11th April. I completely ignored this and did not appeal at the end of the 28(?) day window which is suggested on here. I have now received on the 25th June what seems to be a NTK letter - I can attach a copy of the letter if this would be helpful. So this falls way out of the 28-56 day window as stated in the pofa. However it seems that these companies don't care about that and just go on regardless.

So my question is... do I now appeal using the BPA template to Indigo on their website? On this, I just had a look at their online appeal page and it states the following... "Please note that Penalty Notices received at a Rail Car Park cannot be appealed via POPLA." - the issue here does relate to a Rail Car Park. Or do I just continue to ignore and wait until October 11th comes around?

    As pointed out in the Newbies FAQ you don't need your specific circumstances

    There is only one template appeal so send that for starters.

    Then read up on why no popla for railway property

    Keep up the ping pong for the 6 months you mention and never reveal the owner

    I thought that appeal template was for in the initial window prior to receiving the notice to owner/keeper?

    If not, shall I just fill in the online form on Indigo's website with the template and wait until I receive a reply in the post from them? Is online appeal the way to go initially, rather than printing the template and sending as a letter?

    On the back of the original windscreen "ticket" there was a part about the option of going down the POPLA route, so should I include this in the appeal, or wait to say this in my next letter to them after their reply to the appeal?

    Appeal to POPLA using the template. You win. They lose. they didn't comply with POFA and can't identify the driver.


    You said this wasn't railway land so you don't need to worry about that aspect of things. Indigo do a lot of railway carparks and these are treated differently because they are governed by byelaws, not by private contractual terms made up by a PPC and the procedure for breaching byelaws is completely different.

    Thanks for the info. Sorry for the confusion, but I meant that my issue does relate to a railway car park, and so I meant that on their website they say POPLA does not apply in these cases, and so I was assuming that a rejection to my appeal would not result in them giving me a POPLA code. (Where as the original "ticket" has a section on POPLA on the back of it in terms of appeals)

    Appeal anyway. The time frames are all artificial when it comes to byelaws. When they say it's too late it gives a great reason for a bit of letter tennis getting them to explain why.

    When replying to them there is no need to rush. A letter every 28 days is fine.

    Well, there's two letters' worth. Try once every 2-3 weeks to start, eke it out further if you feel you can, depending on the tone of replies. Get it to 6 months.
