ParkingEye Success

Options
Just wanted to emphasise the importance of the landowner / retailer complaint route, and how it can save a whole lot of time and trouble.

Details were:

ParkingEye Aldi car park 'managed' by ANPR somewhere on the Wirral.

Free parking for customers but driver is supposed to enter reg number onto a system inside the store. On this occasion, the driver did not as they were not aware they had to.

NTK received within POFA timeline, and not the 'magic bullet' NTK unfortunately.

The driver went back to the store to complain to the jobsworth store manager who was no help whatsoever. "It's controlled by an outside company, there's nothing I can do"

I advised the recipient to send the newbie appeal to PE and at the same time email the CEO of Aldi and cc the customer service/complaint dept with a copy of the shopping receipt.

Happy news this morning is that Aldi have told PE to cancel.

I've told the driver to still carry on with the appeals process until they receive the cancellation notice from PE.

So another win for Bluetoffee, and a happy colleague at work.

Moral of the story is read the newbie thread and follow the advice - It works.

So did PE just wander in off the street and set up business without Aldi's permission? I think not. Idiot of a manager.

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

Hospital car parks and residential complex tickets have been especially mentioned.

The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

and complain in the most robust terms to your MP. With a fair wind they will be out of business by Christmas.

    So another win for Bluetoffee,
    You always do!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

    Well done Bluetoffee

Complaining as a customer to the CEO is always
the first and best thing to do ..... immediately

Store managers are only jobs worth staff much as
the same as the banks whose managers have
    very little power nowadays.

Supermarkets should look after their customers
first and foremost and they should wake up to the
fact that they have been sold a pup by the parking
scammers, I have yet to see a vermin run car park
    where there are no spaces.
The supermarkets wrongly think they should employ
a scammer because of abuse, there will always be
abuse but nowhere near to what supermarkets think.

With one, two or three hours available and then £100
thereafter is a very odd way to increase your profits

Well I hope that there was a "privacy notice" next to the keyboard to explain what the personal data will be used for and by whom.

Thanks Umkomaas - I'm pretty pleased with my track record so far. It's all down to the valuable info on this forum and the help and support of the regulars here.

I've got my fingers crossed on a POPLA appeal currently going through, so hoping to report another win soon

Very good point ... as these machines are in store, what
is the liability for the retailer under GDPR
