  • In addition, the photo I was sent of where I was parked was manipulated to show a bench across it but this is clearly not the case in the actual photos of my car. Could be useful as misrepresentation.

Wow, interesting as it's the same location!

That's what I thought, at best they have used a fish eye lense or similar to distort reality, at worst they have used a photo from a time the bench was there or actually photoshopped it but I can't believe they would risk that on something they are relying on for evidence.

Not forgetting when UKPC faked time stamps on photos,
that was their evidence until they were caught out
  • Hi James,
Yes, it's a very popular spot! I have a nice library of examples to demonstrate that the space is in common usage as a parking bay.
I have two threads running with different cases at different stages. I also have another two pending, all for the same spot! Hopefully you'll find the threads useful, and will give you confidence when we win
By all means send over your pics, the more the merrier!
  • James - just been told that bench is actually moveable! I'll check my photos and see if it moves around...

So, we've not heard anything since GS's Particulars of Claim was received on 14th September - is that good or bad? Would have though we'd have something from the Court by now...
  • Finally received the Notice of Allocation dated the 14th November.
    – Claimant has until 4pm 18th December to pay the £25 Court free
    – We have until 4pm 26th November to submit a revised/amended defence based on the amended Claimant Particulars

QUESTION - if we don't want to change, do we still need to submit again?

    – Documents need to be submitted by 18th December
    – Witness Statements need to be submitted by 18th December

    So, here we go again!
After having won an identical case last week, I'm hopeful we can see this one off, as:
    – it's a different Judge!
    – We know what to focus on, and we can cut out all the extraneous information this time.

  • Hi Glosandy, i'm also due to submit my witness statements for an almost identical case at the whittle court site, i was parked on the road instead where there is usually a number of other cars parked. I have tried to find existing cases that have been won at the site so I can reference out, but with no joy. I don't suppose you have managed to find any in preparing your statement? I will also need to respond on 18th Dec so assume we will be in court on the same day! Details of my case here if of use: https://forums.moneysavingexpert.com/discussion/5705136
  • HI tomberg,

    https://forums.moneysavingexpert.com/discussion/5864833glosandy

The link above is to my first Whittle Square court case, which we won. This thread is or the second case, I'm helping on another two at the same location!

    Key things that swung it for the first case were;
    – signage on entering the private land
    – common usage o the space for parking (pretty sure that's still the case for on-road parking, I've seen cars parked there many times)
    – lack of bay markings (and probably in your case yellow lines etc.)

The WS dues in on the 18th is a cut & paste for me. Court date set for 15th Jan at Gloucester with Judge Singleton.

    Cheers
