    Judges will always look at the [presented] facts. There is never the need to turn up. Turning up is only needed in marginal cases. The OP said "I am on pretty good ground with my defence of Excel not knowing who the driver was, and before POFA can not pursue the registered keeper"

    It appears he was correct in that and in his guess it wasn't worth his time.

    That's 7 times I've beaten Excel.
    I would say I could beat them with one hand tied behind my back, but to beat them without having to turn up.
    Ouch.....

    The common law of business balance prohibits paying a little and getting a lot. If you deal with the lowest bidder, it is well to add something for the risk you run, and if you do that you will have enough to pay for something better.
