having just checked it would appear that probate was granted in December 31st in Wales (not sure if that’s relevant but the deceased lived and was from the North of England).

December 31st in what year ?

The executor will have applied to their local probate office, which is not necessarily the same as the one for the deceased.

Hi December 2015, they both lived in the same town.

Sorry I’m not being very clear I’m still shocked to be honest. Mum’s partner died in August 2015, records show probate was granted in Wales in December 2015. The son (the executor) lived in the same town as his father and had done for many years.

I am a bit confused - what are you hoping the son will do? Has your mum received the 70k ? or do they need to sell the house to fund it ?

    Hi,

Will states 70k to my mum the additional money and the property to the son. The son is the executor so I would have expected him to arrange for my mum to receive the 70k. We haven’t pursued as he claimed that his sister contesting the will meant it probate hadn’t been granted.

I suppose it’s just upsetting that he does still have contact with my mum and must have lied about this 😔

can see the problem (was this the notice in the gazette or the actual probate record from gov.uk ?)

would be tempted to send him a copy of the probate record and ask him if he was aware that it had gone through?

I hadn’t checked to see if in the Gazette I got the record from Gov. Uk. I think I’ll let him know that I’m aware and give him the opportunity to put it right without upsetting my mum. It was a social media request from him to “like” his new business that made me think I really should check....

I think giving him the opportunity to put it right is the best thing to do. Hopefully he will admit and sort things out
