A NIP is not challengable: it's merely a notice that an offence has .been alleged. A reply to the associated s172 request to name the driver is mandatory.shaun_from_Africa wrote: »Any NIP is challengeable but unless you have good solid reasons for doing so, it would be pointless.
What reasons do you have?
The nominated driver will probably receive the offer of a fixed penalty or a course. Again, not challengable
You have the right to ignore these offers and go to court, where you can "challenge" the prosecution case. Unless you have a good defence, that could prove expensive.0 -
What is your defence? If you go to court they will have evidence against you. You need a defence.0

Received by my wife as registered keeper.
Exceeding a variable speed limit.
Recorded at 63mph
Variable speed limit 50mph between Jnc 10 and 11northbound M1
I was driving.
Are these things challengeable?
Thanks in advance.
Of course they are.
Remember to report back and let us all know how you get on.0 -
Presumably you acknowledge you were doing that speed? At a measured 63mph your speedometer was probably reading 67mph or thereabouts. On what grounds would you challenge it?0

Wonder if you were one of those who went bombing past me last Friday night on that stretch in braindead mode on their way to their holidays when they'd reduced the speed limit to 50 then 40MPH. If so you weren't on your own, quite a few ended up being flashed on that stretch between 9 and 11 that night.
If it was on the evening and you take it to court be aware they were doing it to put roadworks out so it might not go down too well with the magistrate given it was done for safety reasons and not congestion. This is a system account and does not represent a real person.
