    I!!!8217;ve looked everywhere for a answer but with no luck I!!!8217;m hoping maybe you could help. As you know I won my pip on the 20th June. I!!!8217;ve left it 2 weeks and phoned them yesterday. They confirmed they had received it and that the case manager was aware. However they couldn!!!8217;t tell me if they were sending of for a SOR, it!!!8217;s really stressing me out. If they was to send of for one when would I first know about it would they write and tell me before they did so or would I only know once a copy has been sent to me? They have until 18th July to ask for it. I!!!8217;ve read that once they ask for one it could takes weeks for them to receive it and when they do that will give them a further 28 days to put in a appeal. I can!!!8217;t stop worrying about it I!!!8217;m not sleeping and I!!!8217;m not eating properly due to the stress of it all. It!!!8217;s already taken almost 69 weeks to get to this point. At this point I!!!8217;m actually wondering if it was and is worth all this stress. They know I have bipolar surely someone there would be aware that this can make my mental health so much worse.     IMO this is more of a delaying tactic by the DWP.

    To get a decision set aside, it is necessary to identify an error in law by the tribunal panel. They can't dispute the decision, they can only try to find that the tribunal made an error in law coming to their decision. The panel are aware that this may happen, so the S of R is always very carefully written.

    I think it very rare for the DWP to succeed with this tactic (particularly if they didn't have a presenting officer at the hearing). Certainly at my local CAB it has never happened that a decision has been set aside after a DWP challenge.

    I also think it's a tactic by the DWP to dissuade people from appealing and create stress. Don't let it worry you too much. I would see it as a last desperate throw of the dice by the DWP - don't give them the satisfaction of letting it affect you.

    Thankyou for reply they did have a representive there which is another thing I find quite worrying she!!!8217;s the one that told me to chase it up after 2 weeks she asked me 2 questions in the actual room and I honestly believe that if they don!!!8217;t agree with something to say so there and then. I!!!8217;ve got to wait these next 3 weeks out I suppose and hope for the best but all I keep seeing is how many they are actually disputing now. This whole saga has been a nightmare. Hope to update soon with some good news maybe
  • Hi just wondered if any one new how long it takes to get ur letter from pip when u win ur appeal .. I won my appeal for my daughter as i was her carer it was took of us 18 months ago..and we was put on universal credit.. After appealing the judge said it should of never been took away.. We got a form in court / from the judge and he said he was awarding us 17 months back pay to may 17 .. Rang pip / they got conermation. But not heard nothing since that 5 weeks ago ...any one no what happens next ty .. 🙌

    Information on posts 2 and 5 in this thread should help.

    May be worth ringing DWP to ask for an update. Often the money will appear in your account before a letter arrives but a 6 week wait is not unusual.
    Information I post is for England unless otherwise stated. Some rules may be different in other parts of UK.

    I know this doesn't happen for everyone, but I had much the same situation. Autism, lots of lies told in report, virtually nil points awarded. Small change after MR, but not enough. Went to tribunal and awarded enhanced care and mobility.

    I had to wait about three weeks in total, then I had a phone call from DWP to check my bank account was the same, money was paid within a week. Much quicker than I expected.

    I think the DWP do normally phone you once a decision maker looks at the Tribunal findings and decide to not challenge them. That's how you know its going to be paid very soon. To be honest I could tell the person who phoned me was a bit shame faced. It must be an awful job.., good news to give but very aware all claimants are put through unnecessary stress to get there. They must employ assessors from very special places with 'hard heart with no conscience at all' written in the area code lol. Most DWP people I deal with are just normal human beings lol.
