DRP debt recovery and smart parking

hi, im writing for a friend who has received a debt recovery letter for £160 acting for smart parking.

the friend says that they have received nothing from smart parking before this debt recovery letter.

the debt recovery letter was issued on 7/06 but the friend only received the letter within the last 7 days, unsure exactly what day as they were on holiday.

DRP want payment by 21/06


i am aware the car park in question is ANPR, but as no notice to keeper has been received according to my friend we don't know the time scales. to see if they are in accordance with pofa.

any advice is much appreciated

    send the appeal template to not so SMART anyway, even if it gets rejected, keep a copy and the date sent etc (free cert of posting from the PO Counter ideally)


    IGNORE drp, completely (see post #4 of the NEWBIES FAQ sticky thread for details)


    SAR bomb SMART as well, for free , under the new GDPR to get all the photos and paperwork etc

    also as there is no information on the debt recovery letter on how to contact smart parking, im guessing they appeal on an online portal on smarts website?

    SAR = Subject Access Request


    the keeper of this vehicle will contact not so SMART and demand all documents and photos etc with their details due to being the RK , WHICH THEY SHOULD GET WITHIN 30 DAYS, using the new 2018 DPA called GDPR

    they can then send SMART the appeal template using the pcn ref smart issued, which should have been on the DRP paperwork

    Pretty sure we had a thread where Steve Clark at the BPA said in April, that he would compile a dossier, if people who had evidence of Smart Parking going straight to DRP stage, contacted him:

    We promised to send everyone in his direction, so the FRIEND (not you!!!) must email a complaint & copy of the DRP letter NOW. The friend needs to be careful not to say who was driving, but clearly tell Steve Clark that the first letter was from DRP, and he understands from MSE forums that Steve is keeping tabs on this significant and repeated issue with Smart Parking.

    Thankyou, ive only just read this as ive been on holiday, after my friend appealed to smart parking they didn't reply, but today he got another DRP letter, ive told him to ignore the letter completely, they are asking for £160 so even if it went to court im guessing they can only claim the original amount anyway as the driver has not been identified.

    i will tell him complain about DRP to the BPA as suggested asap. many thanks

    Sorry, i knew what you meant, I just worded my reply on here badly.

    I drafted a complaint for my said friend to send as you suggested, and today they received a reply from steve at the BPA basically saying that Smart Parking provided him with copies of their original documents but he had no way of knowing if they were sent or not.

    As a gesture of good will the charge has now been cancelled, in the hope that my friend doesn't think they are all bullies (we referred to hansard in the complaint and accused them of using bully tactics)
    although this is in know way an admission of liability on smart parkings behalf.

    not the exact wording but you get the picture.
