Parking Charge Notice - but I paid.

I've received a parking charge notice this morning from Smart Parking relating to a car park used in Cornwall last month.


Parking was at St Pirans Inn near Newquay for just under an hour and the parking fee was paid for at least one hour if not longer.

The ticket is not available so there is no evidence of paying and clearly Smart Parking think someone didnt pay because they've sent me the PCN. Their paperwork says the parking was for about 53 mins. They have photographs to back it up.



I know I can appeal but without any evidence is there any point?

    send the template from the NEWBIES FAQ sticky thread, appealing as keeper, no blabbing about who was driving


    check the timescales and wording of the NTK against POFA2012 too


    I would assume the VRM was put in incorrectly, so hopefully there is a close match on their system , to prove payment


    in future, keep all payment receipts for 3 to 6 months

    I've had a look at POFA 2012 and I'm wondering if I've understood it. I think I fall under the ANPR stuff and so I reckon they have this lot wrong:



    1. They have to notify the keeper within 14 days of them parking there. The parking was 29th May and their letter is dated 18th June.


    2. They have to set out how much should have been paid to park and they haven't although they have referred to "advertised terms and conditions"


    3. They haven't set out that if the keeper doesn't let them know the driver's details the registered keeper is liable after 28 days. .



    Have I got this right? If I have, do I appeal on these grounds too?

    they have to notify THE KEEPER within 14 days , so by day 15, plus warn them about POFA2012 if the keeper fails to identify the driver

    they failed the timeline and wording , so its slam dunk appeal at popla, where this will be one of several legal points raised

    NEVER identify who was driving , not on here, not anywhere

    so edit your posts asap , these numpties read public forums !!!

    the DRIVER


    the KEEPER

    NOT THE FOLLOWING WORDS, WHICH ARE TABOO

    "MY , ME , MYSELF & I"

    play it like politicians , not blabbers :)

    Well, I went onto the Smart Parking website to appeal and when I tried to start the appeal process it said:


    [FONT=&quot]The Parking Charge Notice (PCN) has been cancelled. No appeal is necessary. If you would like to contact the Parking Office regarding this Parking Charge Notice please call the office on 0845 230 3081 and select option 4.[/FONT]

    mmmm , wonder if they have read your thread and realise its a slam dunk loss for them ? lol


    or they checked what was paid for and realised they should have realised that the VRM that was input was similar to the one on ANPR ?


    we shall never know


    but now you are forewarned for the next time you get a pcn (which you will , trust me , as they infest thousands of private car parks including hospitals, doctors , supermarkets , attractions , retail parks etc)
  • Exacelty the same notice received today .. parked there on the 27 may 2018 , paid for ticket and received fine .. logged appeal , appeal accepted and said no further action , don’t trust them so will ring to check tomorrow fine has been cancelled

    Just a question tho my other half was driving and I’m the keeper ...

    Also why has the website accepted appeal with no reasons on my end entered in

    Looks like their system failed to compare the data streams properly (the ANPR with the PDT machines). This is a data processing issue that they may well ha profited from so it needs investigating and possibly reporting to the Information Commissioner.

    NEVER PHONE A PARKING FIRM!

    Both posters on this thread should send Smart Parking a SAR - with a copy of your V5 registered keeper proof of car ownership - asking for all data (ANPR and PDT machine and all manual checking notes explaining the error and reason for blanket cancellation, then (after getting the SAR reply) complain to Steve Clark at the BPA to investigate whether any victims actually paid and were not refunded:

    Sounds like an all-day error with the system (or more than one day) and if Smart have kept any money from deluded saps who have paid, that would be fraudulent.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
