Speeding Fine - New Fines - Advice

Hi,

I just wanted some advise if anyone has been fined under the new laws for speeding.

I have had a fine through for speeding at 56 mph on a 40 dual carriage way. So stupid I know, and I'm mad at myself for going this fast. Lesson learnt.

I understand its a band B fine so 4-6 points and then 100-125% percent of your weekly wage, however here is where it gets complicated. I used to work for a company but I didn't get paid a wage for 2 months and I left due to this, I have been doing commission only work recently so have had a small last month and due to have the same again this month. I am pressing for the 2 months wages that I am owed to be paid, but I am just worried that if they are paid all at once, that this could look like one monthly wage and I would have to pay a quarter of this? I've not had a payslip recently however I do have bank statements so show the amount sent over to me. My pay slips from my previous employment were up and down each month but I would be able to give the annual salary if needed.

Does anyone have experience of filling out the form and know what information and proof they ask for?

    Since 56 in a 40 qualifies for a fixed penalty (3 points and £100), the banding is of no consequence.

    Quite correct, the OP appears to be someone else who's fallen victim to the very poor reporting by the press of the changes to the fines imposed in the more serious cases where it ends up in court.

    Are you sure? I would be very happy if so!

    From looking at the guide on the sentencing council website it seems like 56 mph in a 40 is just 1mph into Band B category :(

    That only applies if the case actually goes to court.

    For that to happen (and assuming you have named yourself as the driver and no correspondence has gone astray) you would have to have pleaded not guilty, or have ignored or declined the offer of a fixed penalty (£100 & 3 points).

    What EXACTLY have you received ?

    They recommend court starts at 66 in a 40.

    Ah really! I have had a notice of intention to prosecute requesting driver information which I am going to fill out and send back this week.
