As the "confusion" if there is any, rests between French and REAL English, which are both much older than American English, then the "confusion" must surely have existed before American English came into being.
The main "confusion" would seem to be caused by the French generally using one word, Tortue, for Tortoise, Turtle and Terrapin.0 -

I agree with John Arnold as the answer. Seems he created the thing, John Roger Arnold was his son.
