Neighbour trying to claim my land as hers!!

  • As to "how can people be this thick?" - at some level (assuming she knows very well it's yours - and there hasnt been a Land Registry mix-up registering it to you both) then:

    - She perceives some advantage to herself from grabbing your land.

    That advantage could be that it would make her house worth more (and she doesnt care that it would make your house worth less in the process).

    It's gradually becoming clearer that the reasons why my nfh were trespassing was to try and make their houses worth more (at my expense) and one of them seems to have had "official right to use my garden" (which is what they were after by the look of it) as part of their "retirement plan" to make it easier to sell their VERY VERY difficult-to-sell house more of a viable proposition than it really is.

    I'd say your neighbour certainly isn't thick - she's scheming.

    If you are going to put rocks down, get heavy ones which will take at least 2 people to lift and shift.

    Make absolutely sure that the land actually is yours before you put any deterrent down - as advised above check both hers and your land registry documents before you do anything.

    There is also the fact that, should you sell and the problem neighbour has not moved out when you do sell then you would have to declare nuisance neighbours and the dispute.

    We had something similar when we moved in to our property two years ago, on the left of our double garage there is a nice sized bonus piece of land that runs down the side. Our garages are set back from our house so you can't easily see it unless you look out of the side kitchen door or from the upstairs windows.

    We kept coming home to see cars parked all over it, we eventually discovered it was our neighbors to our left (who are actually behind us) that were using it as their friends and families overflow car park even though there was plenty of room to park on the road next to it,

    Our house had been rented out for 2-3 years to various people before we bought it so it appeared as though they had decided to slowly claim it as there's. When we first moved in she saw me in the garage and said hello and asked if we were renting or had bought it, when I said we had bought it I think she decided it was a good time to try and sneakily claim it once and for all,

    A few weeks later my wife came home to see a gardener trimming the bushes paid for by the neighbor and she politely asked him to stop.

    After more cars were parked there (always different cars so never fully knew who's guests) I'd had enough and made two no parking signs and put them in the grass on stakes.

    The next morning I left for work and they were definitely still there (I was admiring my handy work ) , my wife came out of the house 1.5hrs later to go to work and both signs were snapped off leaving just the wooden stakes.

    I fixed them again and finally she came around one morning and made a feeble attempt to say it was her land and was on her title plan but asked us to check anyway on ours, I actually said "one second I have it on an email on my phone" and she said that's ok, just check later and promptly disappeared.

    Paid online and got her deeds and ours and posted them to her next day,. never had a problem since,

    But it shows what some neighbors will do to try and pull a fast one especially when they or you are new

  • People seem to be missing the point that this neighbour is not claiming she owns the land, so her deeds won't add anything. She is just claiming that the OP doesn't own it.

    Last question/answer: Yes, she is.

    Unfortunately, a lot of people think "if it's not fenced in, I can use that how I wish" - and if you show them the deeds they don't give a hoot.

    Is there any way you can fence it all in and say "bugga ya"?

    I've learnt that owning land that you cannot fence in is a bummer when thick people do what they like on/over your land.

    ... you wait until their 3 kids, the daughter's 2 kids, 2 from round the corner and a couple of visiting cousins are playing football down there for 4-5 hours bashing the fence and generally being raucous..... "where are the kids supposed to play then?" (Not my problem doesn't seem to sink in).

    You can't argue with stupid I'm afraid.... and gobby stupid is the worst type.

    It's increasingly the way of the modern world - half the "Neighbours from Hell" programmes are people in the WRONG moaning about those who are in the right, and the programme never corrects them!

    I've got annoying neighbours, I'm selling up .... and will not buy anything I can't fence in....

    You might do that before tossing down gravel to park on.

    If so I will explain, more simply, for you.

    She isn't claiming she owns the land. Showing her her deeds that prove she doesn't own it won't further the discussion at all as her response will simply be "I never claimed I did but neither do you." There is absolutely no dispute between any of the parties as to what is on her deeds.

    The dispute, such as it is, is about what is on the OP's deeds.
