how to challenge an accident claim when you were "at fault"

I don't believe I was at fault and the other car had no evidence. The claim has already been settled but I have just found out about it, which is making it a nightmare to get future insurance. I was a named driver on someone else policy who had a protected NCD so I had basically no say in the matter, because it wasn't my policy and I don't think they were very bothered as they were not driving.

if it's been settled in my absence and the company won't even tell me why they came to a "fault decision". how can I go about challenging this? Given that it wasn't my policy.

the reason why I'm quite bothered is because the claim has come to £17k, which is a load of inflated repair costs and "whiplash" from the other party.

    If the insurance company covering you has accepted liability and has paid out I can't see there is anything you can do to alter things.

    The cost of the claim will not alter the effect on your insurance, if the claim was exaggerated that was also for the insurer to challenge.

    If you want some independent views on fault post up what happened (and be prepared for some judgemental opinions!)

    Well the insurance co did feel you were entirely at fault and according to your earlier thread I'd agree with them. Either way they've settled so there's nothing you can do other than take it up with the ombudsman, but I'll doubt you'll get anywhere.

    One accident shouldn't make getting insurance "a nightmare". Is there some history you haven't told us about?

    Will the ombudsman even speak to him? It's not his policy.
  • OP moved into the path of a vehicle on his right, open and shut case in my view.

    Except the OP has obtained dashcam footage from (presumably) a following vehicle showing the other driver being partially responsible.

    OP - Was this ever forwarded to the insurer?

    Depends how you read it - I understood first reaction of the other driver was to brake (understandable) then realising it was impossible to avoid the car pulling in to his (or her) lane decided the only possible way of avoiding the accident was to try to get past before the OP blocked the lane but was unsuccessful.
    OP was obviously unaware of the car behind him by pulling out.

    I didn't read it that way. The OP pulled out into the lane of another vehicle and caused the accident, it's pretty straight forward.
