Op, you need to get a copy of your transfer deed, as that will have a plan in it drawn to a scale. You can then use this to calculate the size of your plot.
In terms of whether they have to go to court, the answer is no. You have not been there long enough to claim any form of adverse possession. All they are doing therefore is rectifying a boundary (if what they are saying is true).0 -

OP, apart from anything else, if you have a mortgage then the developers can't just take back land over which your lender has a charge (without asking you to ask your lender for consent). So if that isn't what's happening, then I suspect all they're doing is correcting the physical boundaries to match the legal ones on the plans.0

Check Title Deeds to confirm ownership of land in question, and any rights any third party may have over the land.
The developer presenting the area as part of your garden and/or you using the area as part of your garden for one year does not make it your garden.0
