CP Plus Pease Pottage

Hi

I have a charge notice from CP Plus for overstaying the 2 free hours. The driver didn't notice any signs on the way into the carpark, but wasn't expecting there to be a charge for parking at motorway services so wasn't really looking IYKWIM. The driver was in the Costa having a meeting with a supplier.

I will apply directly to CP plus appeals as per the template letter on the newbies sticky thread. I have since reviewed the dashcam footage, and find that the sign visible from where the car was parked is quite small with no red/large lettering. Is it worth adding this info to the appeal?

Any advice gratefully received. Thanks.

Don't think I will get anywhere with them with a sympathy vote, but the driver couldn't afford the time to drive all the way over to his office for the meeting, as drivers partner is having treatment for cancer, and the kids need to be ferried to school etc and driver doesnt want to be too far should there be an emergency.

The main reason not to add stuff like that is that it identifies the appellant as the driver, whereas this is in fact the point that will win it (no keeper liability).

  • Thanks. Appreciated.
  • Aargh, in order to get into the appeals part of the website, you have to select an option to confirm you are the driver, or deny you were the driver. Is there a way around this?

What do you think is the right box to tick? How many times do you think people keep throwing such stuff at us instead of simply ticking the right box (obviously NOT driver).

Just do the appeal, no need to hand hold you through every simple stage.

    No, don't post it...

  • Thanks for taking the time to answer. It's only obvious if you know what you're doing, to some of us this is totally foreign. Ticking the not driver box feels like officially lying, which feels quite different to declining to answer the question if you know what I mean?

CP Plus cannot have a box that ONLY asks 'were you the driver?' They are not allowed to make it a condition of being able to appeal.

    Surely the question says more.

You now need to edit post #8 to remove clues to the driver's identity.

The parking companies trawl forums like this just waiting for people to trip themselves up and can use your posts against you.

No, it is in English. If you wish to beat this you must make an effort. This is not painting by numbers, you will have to grasp some difficult legal concepts, and jump through several hoops.
You never know how far you can go until you go too far.
