The company will not accept any issue with identify theft or clearing the accounts (or removing late markers etc) unless she is prepared to progress with a fraud complaint against her mother. If she isn't prepared to then she's essentially confirming she is at least accepting of the use of her name with the companies, even if she's not happy about it

People are rich because they spend less money. A poor man buys $10 boots that last a season or two before he's walking in wet shoes and has to buy another pair. A rich man buys $50 boots that are made better and give him 10 years of dry feet. The poor man has spent $100 over those 10 years and still has wet feet.

So if your fiance doesn't shop her mum in then pretty much when you apply for your mortgage next year you should speak to a specialist broker who deals in adverse credit:

    1. Your partner will have 6 months late payments against her name / possible default

    2. Your partner will have £5k debt against her which will be taken into consideration and deducted from the amount the lender will loan

Does your fiance live with her mum?

So did your fiance only find out about these 4 accounts when she got her credit reports? Has she checked all 3 to make sure there is nothing else that has been taken out?

This is what I'm worried about. Is there any way to transfer the liability to her mother's account?

Again only through reporting her for fraudulently applying for credit in her daughter's name.

They could potentially move the accounts over but that won't change the late payments on your fiancee's record

Yes, she only just found them, I'll get her to check the other reports. The debts should be cleared by the time we apply for a mortgage, it's the repercussions of the 6 month missed payment.

She hasn't lived with her mum whilst the accounts have been open. The electoral register shows that she has lived elsewhere. This is why I'm confused that it was allowed to be opened in her name, even with the wrong date of birth.

Not without implicating your fiance to fraud and potential CIFAS marker for opening an account under material falsehood.

If the debts will all be repaid by next year and your fiance definitely will not go down the fraud route, she will need to understand that by doing so means that you will have to use a specialist adverse credit broker and your mortgage lending pool will be substantially smaller and probably won't be at High Street rates either. Those 6 months of late payments being so recent will be the killer.

Her mother knows your fiancee's DOB and address and must used it when applying. I don't think one can pass id check with only a name and wrong DOB.

But the fiancee hasn't committed fraud. Not even a little bit.
No reliance should be placed on the above! Absolutely none, do you hear?

Report her mother for fraud. That is the only option that gives you any remedy for this situation.

Personally if my parents had done that I would have no hesitation whatsoever in walking straight down to the police station and reporting them. They clearly wouldn't have given a stuff about me when they were doing it so why should I feel guilty when they suffer the consequences?
